Hi guys i need some advice or thoughts if anyone has been in this situation or knows someone who has been in this situation.
So my sister in Canada applied for sponsorship for my parents( in which i come under dependent as i was under 17 that time) we applied back in 2009. However then i came to Canada and studied here, recently finished my education and now on Post graduate work permit.
What happens if my parents get a medical call and I'm in already in Canada do i need to go back to my Native country where the case is processed and get my Medical done and wait until get reply? Problem is I'm working here full time and as you guys know getting a job here is really difficult i don't wanna lose it? I'm confused about this situation please help anyone?

You have your medical done in Canada.

As long as you have a legal status in Canada you can stay in Canada,
you can get your medicals done here....
Even, depending on the province you may qualify to apply for legal status yourself,
many post-graduates go through the Provincial Nominee Program with success...
You may consider that also.
 
ya i'm anticipating that i should be getting immigration through my parents before i even get through applying on my own. that was the main concern if i can stay in canada then hopefully i can get the PR through my parents
 
I am looking at the timeline of the OP. The parents got sponsored with OP as dependent at 17 in 2009. That makes the OP around 22 years old now. The parents are not landed yet, thus OP is not landed either.

Under the old dependent rule, in order to maintain dependent status under the parents, doesn't the OP is suppose to maintain education studies continuously? No breaks. Doesn't it means that once the OP is no longer studying education, he has disqualified himself as a dependent of his parents? He has stated in the post that he has finished his studies and now on PGWP? He basically disqualified himself as a dependent of his parents thus he cannot land as PR.

His sister now must informed CiC to remove her brother from the parents PR sponsorship. Otherwise, her parent's PR sponsorship is jeopardy of being denied PR due to misrepresentation (not removing OP from parent's PR sponsorship)

He was locked in at age 17, which is a Type A dependent. What he does after that, as long as he doesn't become common law or married, he should be fine. Or were the rules totally different for apps in 2009?

You are right. He is locked in since 17. The 19 and over only apply for education if application was submitted when dependent was 19 or over.

My apology. It was an oversight on my part.

The "remain in education" rule applies to dependents who were 22 years old or older and studying full-time since before the age of 22 at the time the app was submitted. Any dependents who were under 22 at the time of applying were locked in based solely on their age, with the only restriction being that they cannot marry or become common-law.


After August 1st, the only way to be a dependent is to be under 19 years old, with the exception of those 19 and over who are financially dependent on parents because of a mental or physical disability. There will be no exception for those 19 and over who are studying.
