I have an common in law spouse that overstayed her Visa now 5 years, we were in the middle of an sponsorship, which we paid for the fees and medical, sent those in but sent in the incomplete package, due to that fact i was trying to buy time for getting my divorce with my Canadian wife at the time. To make a long story short, i finally got divorced last year. and we had not had the funds to complete the sponsorship, lawyers want 3000 to 6000.00 to process her through from start to finish. All had stated that she could be reinstated along with just a spouse sponsorship application. We are not on the radar with Immigration officials, yes we had moved due to work issues, about five times during that period. We now can get married, finally and was told by the church in Canada, they would validate our marriage we did ceremonial in South America, which we never did the government side , now we are ready to move forward, we have 3 children we have in country who were born in south america, and 3 born now in canada. What would be my next steps to get her proper. without having to leave the country.

Sponsorship is $1040, plus the medical/PCC /shipping/etc. fees.You don't need to pay a lawyer. You say you couldn't afford sponsorship. How do you manage to support 6 children and an unemployed spouse?

You need to sponsor her, same as before. When did you submit the first app?
 
In sponsoring her, i had secured job in the oil and gas industry with 120k a year, however 1 year into this , i had lost the job, and been living on savings three years, and now that is drained, and took a full time school program, now just getting back into the industry. Do i need to do an reinstatement of status in canada for wife, or no.

You will have to show you can support your family to qualify. Which children are yours and which are hers? Sounds hard to believe you had 3 children in Canada without your common law having status.

There is no reinstatement of status. She is long past being able to legalize her temporary residency status. You need to sponsor her for PR.
 
What are the status of the children born abroad? Are they your children? If not they shouldn’t be receiving healthcare or schooling plus they would have overstayed as well.
