hello how are you when I was 15 my family overstayed there visa in US.Before that we had pretty good record never overstayed our visa and we would frequently visit in summer Europe and North America. My dad was a business man so we had good immigration record but when his business came in to crisis me and my mom and brother came to US and didn’t know about overstaying and whole visa thing.I was 15 at that time and then recently we came back from US.We came voluntarily and also applied for asylum but after my dad health condition have to came back so we withdrew asylum. In all this I studied hard and didn’t give up for going in to a good Universities.I have a 3.9 gpa and admission consulate in my country told me you can get admitted in top Canadian Universities and I choose University of Toronto as it is the best in Canada. So if I get admitted to university of Toronto which I am very positive I will. Will the Canadian embassy will still deny my student visa because of the overstay in US although I have no criminal record,it was not my intend, have a great GPA,great sat score, good behavior in high school and lots of volunteer stuff. So just want information ASAP that will they still deny it or I have chance of getting study visa because if no then I can apply in different country thank you.

The system's not perfect. No one is denying that. You seems like a smart guy with a bright future whose in a tough spot because of your family. Unfortunately, as others have mentioned your chance of approval is low.

You can try, nothing is stopping you from trying. I just wouldn't keep my hopes up.

If Canada doesn't work out you can always try European universities. They are pretty liberal with their visa policy compared to North American countries. In my opinion you may have a shot at getting a Schengen student visa (especially since you have indicated that you have a clean immigration record with Europe.) Again there are no guarantees here, but your odds are probably better than Canada.

University of Maastricht in Holland is a really good university and the teaching is in English. If you can get into University of Toronto you can easily get in here.

What really affects your chances for a visa is not really the overstay (though this is never good), but the claim for asylum. Once you have that mark on your immigration record travelling to many countries becomes a hassle if not a near impossibility.

Don't let this discourage you from applying for a study permit. Just don't keep your hopes up.

Remember that for the study permit to be granted, the officer must be satisfied that you are a bona-fide student. With a bit of luck your application may end up in the hands of someone who is understanding. You would need to write a really persuasive cover letter.

To clarify on your question about this forum:

We are volunteers. I don't believe anyone on this forum is associated with Immigration Canada. We are not lawyers either. However, many us have a fair grasp of immigration regulations and processes and generally understand how the system tends to work. Some more senior posters have been around a long time and have seen a lot of different cases and thus tend to know that they're talking about.

This forum is a great place to get accurate advice for free. Having started out on this forum as a person with a problem, I can attest to the reliability of the information you will find. However, you are always welcome to consult with a lawyer, though in your case I don't see it being on much help, if any.

Best of luck!

No one here can tell you if you will be approved or refused. It's possible you could be approved - but also certainly possible you could be refused. The only way to find out is to actually apply.

Thank you so much for telling me all this information I really appreciate that. For the asylum part again what can I say it was not my idea to do that it was parents but I don’t blame them because they will never think bad of me and mistakes happen.I want to move forward now and yea I will definitely check in Europe and plus we were not denied asylum we withdrew it because of my dad health condition back home because if we didn’t do that we have to wait four years to meet him and will that asylum thing will be on my record although I was just the dependent under my mom plus it was very early when we left asylum and came back home.I will doubt it will be on my record.Again thank you so much for taking time and answering me.

Thank you so much for replying and do you suggest that I should try applying for study permit because if chances are to low I am not financially stable so that’s why I am confused that if I try i might lost my money.

Do you have enough money to cover all your expenses in Canada? University of Toronto is something like $60,000 a year for tuition room and board for foreign students.

The cost for a study permit is only $150.

You may also need to deposit something with the university when you accept admission, but have a look into their procedures for students who are denied a study permit.
