Hi All,

I am getting married soon in India and staying back there for three months. Earlier i thought of applying for my spouse's visa from India but my lawyer told me it is not possible. I have to be present in Canada to submit my documents and in no way can be applied from India. Is what he saying true?

Yes- it's true. Your lawyer is correct. Since you are a PR you must be living in Canada in order to sponsor your spouse.

That's inland and outland of your spouse. Not yourself as a PR.
Only Canadian citizens can apply when they live outside of Canada.
 
Ohhh... I am really worried now...kind of stuck in a dilemma. i have already booked three months return air ticket. Coming back in Feb 2020.

Should i prepone my ticket and apply in Feb when i come back?

No one can decide whether you should change your ticket. That is entirely your choice.

Sorry i meant is it fine to file the application after three months of my marriage? It won't be too late correct?

No you can file for sponsorship at any point if you meet your RO. It often takes numerous months to gather paperwork, marriage certificate, pictures, etc. before you are ready to apply. You must remain in Canada during the sponsorship process although we have seen IRCC overlook a short vacation.

Thank you so much....i guess I would rather stay back.....go on some vacation...take adequate time to gather paperwork and then apply. The only downside to this could be extra wait.

You can apply 30 years after your marriage. It is entirely your choice.
