Hi all,

Hope you're doing well and keeping safe.
I have applied for my husband's PR sponsorship - outland and have the following queries. He already has a visitor visa for 8 yea
1) Can he come and stay with me for 4-5 months while his application is being processed? I applies this may only, so the process has not started yet.
2) If he comes and stays for 4-5 months and goes back before 6 months, when can he come again (while the application is still being processed).
3) If he gets his visa while he is in Canada, can he submit his passport here itself for stamping?

Any help is appreciated.

Thanks.

1) Provided he can prove his marriage to you and has a valid visa, he should be able to come to Canada. CBSA should let him in, though it's up to the officer's discretion. He will need quarantine plans, etc.

2) There is no hard and fast rule as to how long someone must be away before they can come back.

3) Technically yes, though if he is called for an interview that will be in his home country.

3) If he gets his visa while he is in Canada, can he submit his passport here itself for stamping?

Since you wrote that he already has a visa, assume you mean the COPR and counterfoil visa (if PR application is approved and ready while he is in Canada). Yes, he can. Right now it seems they are issuing PR directly in Canada (without having to go across the border), i.e. a virtual landing. This may change or be a temporary covid measure but shouldn't change that he can receive in Canada, although do consider not known how long it may take.
