Hi

Currently my wife and I are about to take the steps needed to sponsor me into Canada. It's pretty confusing though so the more help the merrier. We have been married since September and I have been living in Canada on my Irish 6 month visitors visa since August. We would like apply outland due to the processing time being so much quicker. This is where the questions start mounting. I am leaving Canada to return to Ireland to get my medical and my daughters medical done on December 13th and have a flight booked to return on February 13th.

1. Do I have to take my medical in Ireland or can I have it done in Canada?
2. Can I return to Canada before we send off our application pack and stay here in Canada on my irish visitors visa?
3. Will immigration check to see if I am in the country and if they do will this derail our application?
4. Why, how and when does immigration ask for my passport during the application? Will they ask for my daughters also?
5. If called for a London based interview will immigration contact me at my Irish address and will they ask for my 2 year old daughter to come with me?
6. When printing off the application forms do we need to get a specific application number to make our application valid and kept filed as one?

Well thats a start I know we have more questions but this will get the ball rolling.

Any extra pieces of advice are all very welcome.

I'm by no means an expert, but I thought I'd chip in where I can.

I think you can get this done in Canada. There must be procedures in place for Inland applicants which should theoretically be available for Outland applicants. Not sure though someone on the forums will certainly know.

2. Can I return to Canada before we send off our application pack and stay here in Canada on my irish visitors visa?
Before you send off your application pack, you're welcome to do whatever you want (under the restrictions of whatever visas you hold).

Nope not that I'm aware of. Pretty sure there are others on the forum who were living in Canada while their applications were being processed Outland.

4. Why, how and when does immigration ask for my passport during the application? Will they ask for my daughters also?
London will ask for your passport near the end of the process. Assuming all goes smoothly (and given current timelines from the July - October London applicants being processed) that will happen in about 3 months. The overall guideline for London however is 80% of cases within 9 months plus the 41 days for sponsor approval. Check: http://www.cic.gc.ca/english/information/times/perm/fc-spouses.asp

Not sure on this one. If I had to guess I'd say probably, but I'm sure other members will know for sure.

When you pay your fees you get your first reference number in the form of your payment receipt (IMM 5401). You can then use that to login to eCas (CIC's tracking service) after a decision has been made on your sponsor's application.

That's as far as I've gotten with my application, but as I understand it once the sponsor is approved, the application gets forwarded to London. When they open it they mark it as In Process and attach a File Number or a Client ID or something like that.

Anyways, before you send your application, there are no IDs to consider unless your sponsor wasn't born in Canada in which case they may already have IDs from their immigration proceedings.

Thanks for your response things are a bit clearer now ;) We'd love to hear from a few of the more experienced people on the forum also if at all possible.

Our main concern is we do want to apply Outland but we are worried about any dangers that go with it because I want to come back to Canada whilst my application is being processed. What should we know and avoid by taking this road with the application?

Also the timeline of when I can return to Canada whilst my application is being processed. Do I go anytime? When my wife is approved as a sponsor? Earlier, later?? Eeeeekkkk!! It's all a bit confusing so these questions are vital to us and causing the most stress, heeeeeeeeeelp!!

It doesn't matter where you do your medical, as long as it is an appoved DMP.

You can return to Canada whilst your application is being processed. I left the country and re entered several times while on my visitors visa (visa exempt country)

Do not ship things yet or state that you live in Canada already. You have to "convince" the customs officer if necessary that you are indeed in Canada as a visitor, you don't work in Canada etc.

Whether your wife is approved or not, doesn't really matter. I didn't have any issues before or after my partner was approved.

Just my experiences, in a simular situation as you.
 
You can be in Canada as a visitor for part or all of the time that an outland application is being processed. (Many of us here have done that.) Make sure you retain valid visitor status while here (i.e. submitting an outland application does not automatically grant you status in Canada). If you plan to be in Canada while your application is being processed, make sure you indicate your address in Canada as your "mailing" address on the application so that all correspondence reaches you here.

Keep in mind that if you are called for an interview, it will be held in the UK (not Canada). But hopefully an interview won't be required.

And yes - the medical can be done in Canada. In fact, that's likely the better option since it's typically cheaper to have them done here.

Your wife will first be assessed as a sponsor (Mississauga processing). The file will then be transferred to London for the applicant assessment. However this has no bearing on when you can visit. You can visit at any time.
