I am going to apply for express entry and I am creating a profile for some reasons; I have to leave Canada for 1 or 2 months an emergency situation back home at the same time I want to apply as a resident of Canada I have a work permit and stayed for 1 year in Canada but applying from my home country so my question is
Can I apply as outland if I am on vacation for 2 months back home and wanna apply now from my home country or shall I wait to come back and apply as inland? And what about the police certificate do I need to apply for one from my home country and Canada as well?

You can create your EE profile out of Canada. Since you are an inland applicant, there's no need to say that you are an outland applicant.

Only thing you would want to be mindful of is that if you get an ITA while on a vacation, would you be able to do all the documentation?

I have my docs on my PC
But the IRCC won't consider it as mispresentation? if I said I am in Canada while my passport has the stamp indicating that I left Canada

Okay, let's start again:
1. You don't have an ITA. After ITA, you've 60 days to submit your docs. You are only going on a vacation for 2 months.
2. No. You have a valid work permit and are going to be inland after 2 months of vacation. Also, it is just an EE profile at this stage.
