Out of Status

hi.. i need your help guys. i lost my status here in Canada under foreign worker. Can my partner sponsor me even though i'm out of status right now?

If you and your partner have lived together for at least 365 days (continuously) and have sufficient proof, you can submit an Inland application.

Even though an Outland application is probably faster to process, the Public Policy that allows for those without status to apply for sponsorship, apparently only pertains to those that submit an Inland application. Having said that, there have been a few that submitted an Outland application, and were approved, while other Outland applicants were told to leave Canada, since they did not have valid status.

Your partner isn't even a PR yet, and you're past the 90 days to apply for restoration. You should really just return home, wait for her to get PR, then get her to marry you and apply outland. How long have you guys lived together? If not long, you really should just do the right thing and return home, as you're violating Canada's immigration laws by being out of status here. Also it could cast doubt on the genuineness of your relationship on your sponsorship if you keep continuing to be illegal here.

It REALLY sucks when we (in this case, you) have to read through other posts to get all of the details!

In this case, the OP may still have a problem...if `said' partner and the OP have lived together long enough to be deemed a Common-Law couple, said partner cannot land as a single person.

I can see a problem being if they don't officially become common law before the partner gets her PR.
