out of status

Hello

I have applied for Canadian PR as As family sponsor as my husband is a Canadian and I am out of status since i sent my application by courier to CIC office i didn't get any response from them not even a confirmation letter that my papers has been received. I got confused is that delay because I'm out of status or not ? also i would like to know can i apply for open work permit now. Am i eligible for even if I am out of status?

When did your legal status expire? If it was within the last 90 days, you should apply for Restoration of Status ASAP. If it's approved, you could then immediately apply for the OWP.

If it's been more than 90 days, or if your ROS is denied, you would have to wait until you have your first stage approval (AIP) which would be about 17 months after CIC has received your Inland application.
