My husband is in Canada on a visitor visa. His 180 days are up on November 13th. We got CoPR today. His landing interview is scheduled for the 14th here in Ottawa.

Should I apply for a visitor extension now, so he will have implied status at time of interview? Or will being one day past it be a huge deal?

Thanks!!

One day will not make a difference, just explain to them when u go to landing. You will be paying for extension of visa which will be void after he lands. Just a waste of money.

Although technically you supposed to extend visa 30 days before expiry date. So im not really sure!

If he did plan to go back to his country before the visa expired then there would be no reason to extend. Since the CoPR came before he left he decided to stay here to land instead. (You can say that if that was the case with you.)

He has to have valid status in Canada when he does the landing. I, personally, would apply for the extension....today. Rather spend the $100 and be sure he can complete his landing than not and find out he can't land because he's out of status.
30 days is recommended to apply for an extension, but not required. As long as it's received by IRCC before the expiry date, you'll be fine.

Yeah I thought so.. even one day? I’m kinda hoping the agent won’t realize it :p

I'm kind of thinking that's one of the first things they check......Pay the $100 and apply and then withdraw the application the day after the landing interview. You should get a refund.

Did you apply inland or outland?

We did Outland.

Maybe a more senior member can confirm this but I'm sure I've read somewhere before that, while it is obviously advised, you do not NEED to hold a valid status in Canada to apply outland. Yes you would be in Canada "illegally" but you can be out of status and still obtain PR. As stated that may be mis-information on my part, if so..apologies and I am happy to be corrected!

As a previous poster said to save worry maybe just best to apply for the extension. In the grand scheme of things yes losing $100 sucks, but it isn't a lot for peace of mind. And..you could withdraw after landing as someone else mentioned, and hopefully be refunded.

If you already live in Canada, you have two options to become a permanent resident:

  1. You can make an appointment at one of our offices near where you live in Canada. To do this, contact us by using this Web form.

If your permanent resident visa (or one of your family’s) expires in two months or less, please indicate that you need urgent processing.

  2. If you are not able to make an appointment as set out above, you may leave Canada and return through an international airport or a Canadian land border.

When you arrive, an IRCC officer will interview you, and grant you entry into Canada based on the information in your visa.
In either case, you will have to show the officer:

  • your passport, travel or identity document (including your visa sticker, if you have one), and
  • your Confirmation of Permanent Residence, permanent resident visa, Certificat de sélection du Québec (CSQ), letter of introduction or any instructions from the Canadian visa office, and
  • your proof of legal status in Canada, such as a valid work permit, study permit, temporary resident permit, or visitor document, or any immigration document you have (whether valid or not), or
  • proof of implied status (if you applied to extend your stay before it ended). Proof of this status may include:
    • payment receipt,
    • copy of your application to extend your stay,
    • printout of online application, or
    • proof of mailing.

The other option is to drive from Ottawa to a border crossing and flagpole. No need to apply for an extension in that situation. Probably Johnstown would be the closest crossing.

I called CBSA about that this morning and they advised against it. The only time we’d be able to go to the border is this weekend and apparently if the border is too busy they can refuse to process your landing and will book you an appointment instead. Not sure we want to drive over for nothing, especially with a newborn baby in tow.

Well, that might be the case, but they could also revise extend his visa if they do refuse to process it, saving you the $100 (although with gas prices, it's probably about the same amount). And he could always go by himself...you and the baby could have a sleep day and pack him off early in the morning! ;)

Wait.. is the entry valid for 6 months, or 180 days?? I was counting 180 days but if it’s actually 6 months we’d be ok.. I’ve seen information stating both numbers which got me all confused.

Husband has a multiple entry bet that is valid until April 2018, but his last entry to Canada was in May 2017..
