Hi guys, this forum had helped me a lot with the concerns I have had in getting my PR so I am looking for expertise and suggestions from you wonderful people.

This is concerning my brother who came to Canada on 2011 as a student, unfortunately he failed one of the courses on his final semester and he hid that fact from his family, long story short his work permit expired and he was unaware of it till it was couple of months after the expiration. He have seen couple of immigration consultants with no one giving him a definite solution. He worked cash jobs to sustain himself till now and his passport is expiring within a year. He haven't applied for restoration of status or for a work permit yet, so as a last resort he is looking to flag pole somewhere in Ontario (not Niagara) with a work permit application, I know the chances are slim to none as he have been overstaying for years, he have no factor of inadmissibility on him, he provides for his family back home so I was wondering if anyone had any suggestions or recommendations on this and thank you :)

Flagpoling requires that you be eligible for a permit. He doesn’t qualify. Identifying himself may start the removal process but living in Canada working for cash is not a longterm solution either.

Flagpoling is a bad idea. There's zero chance of success given his status in Canada (as well as how long he has been here illegally and the fact he has worked without authorization). If he tries, he should expect he'll end up with a 1 year exclusion order (1 year ban) and will be sent home. (Also, I'm assuming he would be trying to flagpole with a work permit application, job offer and approved LMIA - not just the work permit application alone.)

Instead, he should return home and spend 1-2 years there re-establishing ties (e.g. job, property, employment). Once he's done that, he can try applying for a work permit. Chances of success will still be low but higher than they are right now.

Best option would be to return home and apply for economic immigration through a stream like Express Entry if he qualifies.

From a previous posting you made , you’re well aware the importance of staying in status .
Why would you believe your sibling would be any different? In fact, his situation is FAR worse then yours
No status , working illegally. Hasn’t taken any definitive steps to correct his situation
