Hi,

I have an open work permit. My husband has a work permit as intra-company transferee (because he set a small business in Toronto, on basis of the NAFTA agreement). I work for him as a secretary and I want to apply for my permanent residence. Does anyone know if I need a LMO and an arranged employment offer? I think I just can apply in the category of Federal Skil Worker with Arranged Employment offer.

I will appreciate any advice,

Thanks in advance!

If you want to apply as skilled workers, your husband would have to apply as the Principal Applicant, since you cannot apply for FSW2 on an open spousal work permit. Your husband's job would have to be in Skill Types 0, A or B on the HRDSC matrix.

Or if you did want to apply as the Principal Applicant in your own right, you would need your own full approved work permit, and your husband's company would have to advertise the job for at least 2 weeks in the past 3 months and then you'll need an LMO from HRDSC, and of course your job would need to be in Skill Types 0, A or B
