My common law hubby left me and his three kids for a young Canadian girl.He is now miserable,misses his kids and is waiting on that residency.Since we were moving for a foreign country and all was sold to move to Canada,he actually went ahead for his job,then met her.I am the kids have been all over and basically living out of our suitcases since he left.He is now crying for the kids to be there close by,I have no ties anywhere and ultimately want to see my kids happy.It would also be much easier for us all the help each other with the kids.It is exhausting for me alone!So I went to the Canadian consulate here in NY and there was no one to talk to,just a drop of center for the forms online,but I really don't know what forms to fill and what i should file for myself and the kids.So I am left out in the cold,Canada is planning to give this guy a residency,so can anyone out there tell me what are the option for these kids,since Canada is like the crickets in the background!It really is incredible that there is no one to consult with regarding this,no representation from Canada.I am a single mom of three and there is no way I can afford an expensive lawyer.So Canada should look at a man and his kids,the whole picture,not half!!!!!!!!!!!Any help will be much appreciated!

His kids can and should be included in his application. It's pretty straight-forward and there's no issue getting them residency. He's the one who has to include them in the forms he is going to fill out (i.e. they need to be included as part of his application - not separately). They will need a medical as part of this process.

Unfortunately it's true that you cannot get residency along with them. However you could look into immigrating independently.

He must declare his children on his application for permanent residence. They should be medically examined, and if he includes them as accompanying dependents they can get residence too and go to live with him. On the other hand, if he does not declare the children and does not have them medically examined, he can never sponsor them in the future and he is guilty of misrepresentation for failing to declare his dependents.
