The company for whom I work is a large conglomerate, with smaller divisions/businesses throughout the world, but headquartered in the US. I'm a US citizen. I'm working with the Director for a unit in Canada, in talks about transferring to a new position located in CA.
Apparently, this shouldn't be difficult given the industry (IT) and I'm a skilled professional worker. What he's not sure about is my husband's status. As far as he understands it, my husband wouldn't be able to work in Canada.
Ironically, this wouldn't be a big deal as he's been unemployed for the last two years, making due as a contractor working on 1099. He's incorporated as an S Corp, to deal with taxes. But this isn't a big whiz bang business; he's an independent consultant, picking up gigs here and there until he can find more formal employment - preferably.
I've been searching this site and the forums, looking for answers as to how my husband could come with me to Canada and either:
1. Continue working as an independent consultant, but doing so from a residence in Canada. In his current roles, he mainly works from his home office, and only very occasionally has to meet with a client who might be in another part of the US. In other words, he could continue doing what he's already doing, possibly traveling to the US to meet with a client once or twice a year.
2. Find full-time employment as an official employee of a Canadian firm as a skilled professional in IT
Is it really true that my husband won't be able to work in Canada simply because he's married to me, someone who can because my employer wants to transfer me to a business unit there?
If it's true that he won't be able to work in Canada, is it possible for him to still operate as an independent consultant, just paying Canadian income taxes instead of US income taxes?
