My brother is 24 yrs old and was sponsored by my mom 3 years ago, he is in Canada now as PR and working full time.

When he immigrated, his status was single. He dated someone but nothing too serious. He recently went back home to visit her and now is sure he wants to bring her here.

However, they have never lived together for 1 year as common law, and he could have chosen to stay back home with her so he doesn't qualify as conjugal partners.


If he just goes back home, get married and come back to Canada, would CIC think the relationship is genuine?

She is a kindergarten teacher with education so really doesn't qualify as skilled worker (only college & vocational instructors)

As long as they have evidence of their relationship, his visit to her, communicating online or on the phone, there's no reason why CIC would think it's a sham marriage.
 
Make sure they do not try to make their application better by exaggerating. DO NOT, for example, claim to have lived together. DO NOT claim to have had anything approaching a common-law relationship. If they do, her application will be rejected because your brother should then have declared her on his form when he immigrated to Canada. If they marry, and are honest about the development of the relationship, everything should be fine.
 
I don't think there will be any problem at all if they get married. it's not necessary to live together before getting married. many people get married just dating on-line only, and got approved. the only thing they look for in your case is the proof that your relationship is genuine.
 
Would it be better for him to sponsor her from Outside Canada (Indonesia)
or for her to apply for a visitor visa with his invitation letter,
and then live together for 12 months,
(not sure how long a visa is good for)

and then sponsor her from within Canada as common-law....
