Im in a weird situation right now and I need your help.

I have applied for Canadian Immigration (Skilled category) in 2005 from U.A.E through a consultant.


Everything was smooth but then I quit my job and moved back to my home country. I recevied my medicals, I submitted IELTS and CHC asked me to submit Police Clearance Certificate from UAE.

Its a very hard process to obtain a PCC from UAE if you are not in the region.

My consultant informed me that they r going to close your file, so pls submit the PCC.
I told my consultant that Im trying my best and I sent them the letter from my previous company saying that we r having problem in administration so its gonna take sometime to get this done.

After a while i got the PCC and I sent it to my consultant and they said they forwarded it to CHC but after few days I received an email from my consultant and it says tht CHC requested for this document many times and u were failed to submit it on time, CHC closed your file and sent your landing fee.

I dont get this, It wasnt in my hand. I kept informing them with my situation and then I did submit the document in the end but i guess I was too late :(

I have waited for the immigration for years and after 4 years what i got is "Refusal due to non-compliance".

Please advice me, what should I do. Can I still appeal or not?

Very sorry to hear that - You can try to appeal, however you appeal where its not your fault and you think your case was wrongfully handled. In this case you basically didn't replied in time with the request, if you have receipts to prove that you submitted the PCC but they didn't gave you in timely manner then you may have a hope.

When they first sent you a letter and after that you should start working on it, they usually gives 90 days to you and if you doesn't comply with the deadline, you need to request more time with all the proofs that you are working on it. But if this is just because your oversight, you will not have any case. UAE police report is pretty easy and fast even if you don't have anyone there, they still give this out to you in timely manner, but the pre-requisites takes a long time to certify your fingerprints before you send them, but again, you are responsible to act fast or buy some more time from them.

I think you should have done everything possible to get this last document that has apparently decided your future (in this case).

In the meantime ask your consultant to write a letter on your behalf to the CIC explaining the situation and keep your fingers crossed, Other than that, personally I don't think you have a chance.
