Hi everyone,

I started my job in August 2011 as Physiotherapy assistant in a nursing home and is still working. So, I almost have accumulated 1950 hours and was thinking to apply for the immigration. I was hired as a subcontractor and was receiving biweekly cheques without tax deduction. I submitted my tax in April, 2012. I work under supervision of Physiotherapist thus my hours, pay and method of working is controlled by the PT and the company who hired me. I received the cheques till March, 2012 after which I started working under payroll with the tax deductions biweekly. Therefore, I do have my biweekly invoices from August 2011 to March 2012 but no pay stubs and no T4 for these months. I started receiving pay stubs from the month of April 2012.

My employer is willing to give me in handwriting for the total number of hours including the pay but is refusing to provide t4 as it is too late now. One of the lawyer and CA told me that I am eligible to apply as I am providing the services as told by my company. Therefore CIC will consider me as an employee not as a self employed or subcontractor. I am confused whether to apply or not as I have read in this forum about the rejections based on missing t4 slips.

I was in same situation but I counted my experience from the company that i received T4s and paystubs. So if u start receiving paystubs from april 2012, u have to wait till april 2013 to be eligible to apply. I still got letter from my subcontractor employer when I applied because i need to get letter from all employers since past 3 years. I never counted that as an experience cos CIC are very strict with T4s and NOAs. Did u report the income from this job to the canada revenue agency?? I was also issued T5018(from subcontractor company) instead of T4. I reported the income to the canada revenue agency and they deducted some taxes and the income appear on my NOA but i still made sure that my hours was completed with T4 company before applying. Wait for seniors here to suggest for u as well. All the best..

Yes, I did report the income from August 2011 to March 2012. I filled T5018 form which clearly report this income as business income also known as self employed income. I am afraid this will definitely create problem.

Ken, you already know the answer. Unfortunately, self-employment is not eligible under CEC. Even if it was "just" the financial arrangements, CIC will not accept it as "employment" experience. BTW - you should have received a T4A for your self-employment income.

Assuming you're applying under the post-graduate stream, ujbaby is correct, you will have to wait until you have been employed for 1 year.

However, you could check with your employer to see if they are willing to help you apply under the PNP program...
 
i have the notice of assesment for 2009, 2010 and 2011.......I am applying under CEC, I have a question, revenue canada send me notice of assessment from 2011 and was saying i have to pay another $1000, and right now i dont have the money to pay.... it would be a problem if i apply ?

You should start a new thread...

I truly don't know - it would have to be part of your background check / admissibility review, I don't know what the criteria are for that. But failure to pay taxes - that would not be good.

If you don't pay the CRA, the amount will continue to grow with penalties and interest. It would be in your best interest all the way around to just pay it as soon as possible, even if that means borrowing.

If you truly have no way of paying it, you could try setting up a payment plan with the CRA -

You may not be given much time to pay, but at least if you show that you are trying to be responsible, it will be better than ignoring it...

Thank you Jes_ON for the reply. Yes, I am applying Post grad scheme. My work permit will expire in 2014 August so I will wait for 6 months more. I did not got T4A I do not know why? I will ask my employer. Well, it is still little disappointing to have my 6 months being wasted.

As T4 of the current year (2012) is not issued yet, What other documents can be use as a proofs of salary other than pay stubs.

I do have a reference letter from my employer saying I have received XXXXX CAD, till date, for the work in 2012. Is this letter sufficient??

The letter is all that is required, along with the most recent T4 and NOA. Obviously, it is not possible to give the 2012 T4s and NOAs until next year. Sometimes CIC will ask for them (or other documents) at a later time.
