Hey everyone, theres so many threads I dont know where to start. Me and my girlfriend want to apply for my residency, We cant do common law because when i was living in canada on my work visa, my work didnt allow us to live together as I worked in a staff accommodation up a mountain. but we were as good as a common law. Just the living wasn't reality because of our work.

So would these reasons be enough for conjugal? or is the only other option for us to get married? I feel like express entry I wouldn't have enough points.
 
If there is nothing actually stopping you from getting married, no barrier to marriage, you won't qualify for conjugal .

You do not mention where the PA is from? But sounds like a Conjugal application will not work for you guys..

Conjugal is defined as "could not live with the sponsor as a couple because of reasons beyond their control (e.g. immigration barrier, religious reasons or sexual orientation)."

A conjugal partner relationship exists where two people are in a marriage-like relationship but are not married and have not lived together for a period of at least one year due to extenuating circumstances as per statement above. There are no such circumstances in your case.

Your options are to get married for spousal sponsorship or live together for 12 months to obtain common law then apply as such. "As good as" is not something that exists or that CIC will accept.

Inland - you must be living in Canada with your sponsor. You can include an open work permit app with your pr application, that would typically take 3/4 months to be granted.

Outland - you can be living in or outside Canada. No work permit option.
 
Thanks for the quick and helpful replies!! So it looks like marriage is our choice. IM back in the UK now and she is born and raised Canadian. So we are basically looking for our quickest and most likely way for us to be back together.

Oh UK ...conjugal is definitely not an option!

Do you qualify for the IEC?
 
I've done my IEC, that's how we met in the first place, but I came back after my visa ran out to see family etc....now our goal is to start a life together in Canada.

Ahhhh gotcha.

Sounds like it is either Express Entry or marriage. Or if she can come to UK and work, get your common law and apply outland.

You need either get married or live together for a full year to become common law before sponsorship will be possible. As others have said, zero chance a conjugal application will be approved.
