Hey guys thanks for your attention, I;m new here preparing for out landing sponsorship with my husband our info and questions listed below, really appreciate if u can help us. Many thanks.
Our background:
My husband is a Caucasian, Canadian citizen, he was born in Canada in 1981 and have been living here for most of his life. He is a VFX artist currently looking for jobs.
I'm a Chinese citizen who was born in 1985, currently live in Beijing working as presales engineer at SAP.
We met each other in Beijing, China. After dated each other for 7 month, we decided to get engaged. But my husband had to leave China, so he came back to Canada in September, I applied Visiting friends and family visa(chaired he was my boyfriend in the application) then I got my 9 years visiting visa.
We got married at my first trip in Canada on Oct 10th.
My questions are:
1. Next time I come to Canada, how do i state to the custom border about my marriage? Is it ok I let them know my husband and I got married this trip and provide them my employment letter from my job also our plan to apply out landing sponsorship?
2. As u see, we plan to apply out landing sponsorship, my husband doesn't have much saving, never paid his tax and he is looking for jobs. We checked other requirements for sponsor on the official website, he fits them. This makes us wonder what exactly does the sponsor need to prove to the government, is it ok we apply after my husband gets a good job and provide them proof of our marriage is genuine?
Many thanks again for your time and help.

Are you sure you don't mean 9 MONTHS visitor visa?

If you have a 9 month visitor visa with re-entry privileges, then it shouldn't be a problem to re-enter Canada. As you said its good to show an employment letter, and also a return airplane ticket for before the visa expires, which is proof you do not intend to overstay in Canada. It shouldn't be a problem telling them you're married if they ask.

Do you intend to apply inland, or outland through Beijing or HK office?

How is your husband living in Canada now with no job? Where does he live and how does he support himself right now?

There is no minimum income requirement for your husband to sponsor you. He just needs to show you both have a plan in place to support yourselves in Canada without having to use social assistance. So basically he can include some of the following:
- make sure he is not on any social assistance/welfare
- show the kind of job he expects to get, and what it typically pays
- if a family member is supporting him financially now, get that person to write a testimonial letter that they will support you both financially after you get PR. This could be as simple as them providing you a home to live in temporarily

The decision here is not based on your husband making $X dollars in salary, it depends on how the visa officer feels about your plan and situation.

For proofs of your genuine marriage, you can show lots of pictures (especially of the wedding with his/your family/friends attending), joint financial account, life insurance, letters from friends/family, and proofs of how you communicate while living long-distance from each other.

Thank you Rob for your kindly reply. My visa expire on 2022, April. It's a multi entry 6 months stay visiting friends and family visa. I think my personal working experience financial situation and travel history give me some credit to get this visa.
My husband currently is living with his family. We plan to apply out landing sponsorship immegration early next year as my job requires me to stay in China for the following year. I think he will be about to find a job by the end of this year. But what is confusing us is my husband has never paid any tax before, does he need to pay tax for the past years? How many years would be good enough?
I personally prefer to look for jobs right after I got PR, after I find a job i will quit my job in China and working in Canada so that I can be with my husband.
Our marriage is genuine and not based on the immegration purpose, his whole family attended our wedding in Canada and we spent our honeynoon at a nice hot spring cabin. We plan to have a small wedding in China early next year. Plus we have many detail info of our daily communication.
As this is our first time to apply, any other tips?
Thanks again!

your husband doesn't need to pay taxes for a long time before applying. AS he just returned to Canada, it's normal that he doesn't have a job yet, and that he hasn't paid taxes.
If you're married, he can apply now. He will be asked for an Option C, which will show that he hasn't paid taxes - he just needs to include an explanation. As a sponsor, he is required to show that he will be able to support you if needed. He can include a letter from family (if he is staying with family now) stating that he can stay with them, if he has some savings, he can explain that. He can also include information on your current situation, your job etc. and how it will allow you to find a job once you're in Canada. Just show CIC that both of you have a plan, and that you won't be needing welfare to survive.

From what you've shared, you seem to have a fairly straightforward application, with lots of proofs of living together, family attending your wedding etc. About your wedding next year - you can mention it, but you shouldn't call it wedding : you already got married, and it would be confusing to say that you will have a small wedding in China - you could say that you will have a celebration in China with your family, or a renewal of vows etc. - but not a marriage.

Do the police checks first, because they tend to take a bit of time to obtain. Leave the medicals for the last minute, as they're only valid for one year, so you would want to do them as close to the sending date as possible.

Other than that - good luck!

Thank you Sweden, you are very helpful. As my husband and I got married in Canada BC we only got one marriage license, and I left it in my husband hands. We plan to valid it in my local government early next year on his trip of visiting my family. I'll double check how long it would take for the local government to get it done. Hopefully the immegration officer would understand the delay as I have to work in Beijing dont have holidays to go back to my hometown to work on this paper work.
After reading your advice we definitely gonna call it a celebration in China. We plan to apply out landing sponsorship in Beijing. Have heard different versions of the processing time, some says very quick within 9 month, some says takes over a year. Anyone has any idea?
Many thanks fellows!

For spousal applications going through Beijing, stage 1 takes about a month and 80% of applications get through stage 2 in 9 months or less. Processing time varies, though, and it sounds like you have a straightforward case, so you could get through stage 2 faster.

Thanks you guys for your help, about paying tax my understanding is that paying tax isn't mandatory for sponsor am I right? In my husband case as he has been working for many years but has never paid any tax before, so apart from writing a explain letter about his time in China for the past two years, is it still better for him to pay tax for the past years? How many years would be helpful for our application?
