Hi,

I got an ITA on January 10, 2019. I am currently on implied status as my work permit expired and I am unemployed right now. So I have applied for visitor visa.

The invitation shows I qualify for both FSW and CEC. I am concerned and would like to know if I can stay in Canada and submit my PR application on this implied status? Will it cause any issues to either my TRV or PR application or both? Also, since I have met both FSW and CEC , how do I know under which category my application is considered ?

Looking forward for your response,

Thanks in advance,

Could you explain how you have implied status? You may have implied visitor status as you have applied inland for a visitor visa. I assume you have not applied for an extension to your work visa so do not have implied status to work. You can apply for PR inland with no problems as a visitor either under implied status or after you receive a visitors visa. If your visitors visa is denied for any reason you would have to leave Canada but could continue your PR application from outside Canada.

As long as you submittted the application to change BEFORE your work permit expired, you are on implied status (as a visitor only; you cannot work).
If you applied after your work permit expired, you are not on implied status...

If you are in fact on implied status, then you are authorized to stay (at least until you get a decision on your visitors permit) and there are no issues with either your PR application or visitors permit.

Also, since I have met both FSW and CEC , how do I know under which category my application is considered ?
If you are eligible for both and you get an ITA, it will be for CEC, by default.

Hi, thank you for your response. It is very helpful. I applied for visitor visa extension before my work permit expired.
