Hi All,

My husband has got the PR approved and he is planning to fly to Canada around march end to get the PR card. He has got a job here in India and he will be getting the transfer to work in Canada. I am a house wife with a kid studying here in India. Since my husband has applied for the PR for himself as the PR cutoff was not matching if he was applying with family.

My husband is planning to apply for spousal sponsorship once he receives the PR card but as far as I know the Spouse sponsorship PR takes around an year whether applied inland or outland, so what could be the possible options by which I can get to fly and stay with my husband for the time being until we receive whole family's PR.

After going through different threads and online posts I and my husband thinks that visitor visa could be the only option but we are worried about the rejection. If we apply for visitor visa mentioning the reason of our return as kid's study, will that work? How can we handle this situation and get to stay in Canada together?
 
Dear Reeash -

Yes, go with visitor visa until you and family not received the PR. Please keep it mind - Apply after a proper settlement of you spouse in Canada. It would be best if he could show himself strongly present in Canada with documents like - Bills, Bank, employment and other documents while sponsoring family. Also focus on the financials (expenses of Canada Trip).

Suggest to apply in month - June 2020.

Unfortunately your chances of approval of a a TRV are pretty low. It will seem pretty clear that you want to remain permanently in Canada. You have no job to return to in India. Unfortunately if you file you application with non-accompanying spouse usually there is a separation unless you had a TRV already. You can certainly try.

Thanks for your reply. So what would you suggest, Shall we apply for visitor visa once my husband flies and gets the PR card or shall we apply now itself and wait for the result?

You can try for TRVs but the chances are low. You can try at anytime. When he moves to Canada he can start the sponsorship process. He must remain in Canada during the sponsorship period although a short vacation of 2-3 months seems to be overlooked. Unfortunately there are good chances that you will be separated for a year.

Thanks for your prompt reply. Me and my husband have stayed in Canada for 2 years on work permit. Will that help in getting the visa? My husband has enough funds in Canadian bank account. We can provide all the bills, bank and other documents related to our stay.

You and your husband are now in India. The VO will be able to see that he received COPR and put family as non-accompanying. To get a TRV you have to prove that you will not be staying in Canada and you are going as a temporary visitor. You can certainly try when you list your family as non-accompanying that usually results in a separation for around a year.
