So here is my situation,I'm 27 and I met a man via Facebook who is 43,just 6 months ago we fell in love and for the first time in 23 years he came to my third world country for one month and meet me for the first time,we got married ceremonial within that month because his divorce isn't officially over so we couldn't marry legally, but as soon as he got done with his divorce he will come and marry me in the court of my country.i have pictures and messages, call records to prove my relationship with him,as he is a loving father to my kids my concern is I don't think he has enough assets to sponsor me and my kids, what kind of assets he requires.hes currently on welfare because of his ex and had a criminal record with her.how long he needs to be off those things before he can sponsored me and my kids or just me alone?do I need to have assets too?

There are a number of barriers right now to him sponsoring you.

First of all, you need to be legally married. So you will need to wait until he has officially divorced and then get married legally.

Secondly, he cannot sponsor you while he is on welfare. He needs to stop taking welfare several months before he applies to sponsor you for PR and will need to remain off welfare while your application is being processed. Assume your application will take at least a year to process. So in order to sponsor you, he should assume he will have to remain off welfare for at least a year and a half - possibly longer.

His criminal may also be a big problem. If he has a criminal record as a result of an assault or something similar against his ex (or another family member) - that may prevent him from sponsoring you.

Your children can be included as dependents in the application.

Thanks but can a lawyer help us?

With the welfare issue? No. Your boyfriend needs to get off welfare and stay off welfare. A lawyer can't help. This is something he has to do himself.

What was he criminally charged with? A lawyer can advise you - but generally a lawyer cannot make a problem go away.

The assets are irrelevant, if your husband is on welfare or has a certain type of criminal record, particularly sexual assault or domestic violence against a spouse or partner, then he will not be able to sponsor you.
