Background: My girlfriend was separated from her husband in the Philippines since 2008 (no divorce in the Philippines). I am separated from my wife here in Canada early 2009 (I am waiting for the final judgement on my divorce, lawyer said in a matter of weeks). We got reconnected late 2009. I visited her twice (4 weeks each time) in 2010. I asked her to fly to the USA in May2011 where we were together for 5 weeks, I came back to Canada to arrange for an appropriate apartment for both of us and she flew here to join me in July 2011 on a visitors visa which was extended to July 15, 2012. We have been living together since May 2011 less the 4 weeks I was looking for an apartment.

1) do we need to extend her visitors visa if we are filing an inland sponsorship for her tomorrow?
2) when does she need to do a medical? (wait for second stage?)
3) is there a form for OWP?
4) do we send the application to Vagerville? This link says Mississauga for Common Law application (cic.gc.ca/english/information/offices/canada/mississauga.asp)

1. Yes. All applicants for PR are required to maintain legally valid status for the duration of their processing.

2. A medical is to be submitted WITH the application.

3. (If there is a separate form for OWP, someone please correct me here.) Use the regular work permit application, ensure you pay the separate processing fee and attach the necessary documents for this application as well. Place it in its own envelope separately, and write on the outside of the envelope that it is an application for an Open Work Permit and is not to be processed until the attached PR application has been assessed for AIP.

4. Inland applications go to Vegreville, yes.

another question. Is outland available to us in the US? if so, can she stay in Canada until the interview? Now that Buffalo is closed, where in the US will it be processed? Where do we mail the application package?
 
Yes, you may sponsor her Outland while you are both in the US, if she is in the US or even if she is visiting with you in Canada. There does not necessarily have to be an interview, it is the exception not the rule. Interviews are convoked if the Immigration officer has concerns regarding the genuineness of the relationship or the admissibility of the foreign national for other reasons (criminality etc).

US applications are now being processed at CPP-Ottawa (and the other offices in Detroit, Seattle and L.A. remain open, I do believe). You mail your application to the Case Processing Centre - Mississauga if you are applying via the Outland route. Outland forms are here: http://www.cic.gc.ca/english/information/applications/fc.asp

the principal applicant, my girlfriend, is a filipina with 10 yrs multiple entry to US...was in US may to july 2011 and in canada since. however, her permit/extension to stay in canada ends on 15 july, tho we have already filed for request to extend again...her canadian visa expires in oct.

we intend to lodge the inland PR application on tuesday after her medical exam on monday but heard that outland is faster. If we file outbound, can we choose where mississauga sends the file after or is based on the applicants citizenship?
 
If she entered the US as a visitor (maximum stay 6 months), her application can't be processed via CPP-Ottawa, it has to go to Manila. You have to be admitted to the US or Canada for at least a year to have qualified to go through Buffalo. As far as I know, the 10-yr multiple entry visas do not permit entry for more than 6 months at a time (I hold one of those visas).

So you would submit the application to CPC-Mississauga and it would go to Manila after that. If she is staying in Canada with you, she has to keep renewing her visitor status. You can include proof that you have submitted a PR application with the extension request, doing this usually encourages them to give the visitor an extension beyond the usual 6 months. Ensure you submit adequate proof of support and all the other required documentation with the extension request.
