I was waiting for the refund of my application which i received NER, didn't enquire for almost 6month and now waiting period was too long i finally enquired about the refund finally got reply today as Good Morning

Your application, E000006017 received by our office on 22 Nov 2010, was assessed and it was determined that the application met ministerial instructions. It was placed into processing and failed on selection due to insufficient points; therefore, no refund will be issued.
but according to Operational Bulletin 218 - June 28, 2010
FSW applications received at the CIO on or after June 26, 2010
The second set of MIs applies to cases received at the CIO on or after June 26, 2010. The CIO will assess complete applications received on or after June 26, 2010, against the MIs to determine whether applicants are eligible for processing. Those determined to be eligible will be placed into processing. Applications that receive a negative determination of eligibility will not be processed and will receive a full refund.
I don't really understand how does this relate.
PLZZZZ experts and seniors share ur opinion about this issue, this is my 4th time, :( :( bad luck, wasted alot of money just for application and still struggling and now they say they won't be refunding...
 
The letter received by you shows:

"It was placed into processing and failed on selection due to insufficient points; therefore, no refund will be issued."

You are not eligible for refund because your application was placed into processing and failed on selection.

If it is at CIO and

"Applications that receive a negative determination of eligibility will not be processed and will receive a full refund".
 
yes, u r right but, how come it was placed into processing without suffiecient points? As far as i remember i got NER from CIO.

I agree, the visa office should explain the reason.

They did. CIO Sydney doesn't make the decision on the points, the VO does. Sydney just checks for the completeness of the application and if the NOC used is valid.
 
But how come the completeness was done without sufficient points? and they never mentioned that my file was sent to VO ,only thing when i inquired CIO they replied Good Afternoon

This surelyy indicates that my application was reviewed by CIO at sydney NS and NER send by CIO not VO.
Please seniors experts and those who received NER pls share ur views.

Re: who got NER coz of insufficient point

Dear forum members i would like to have some information from those who received NER coz of insufficient points about the refund of the processing fee. Please share whether u got refund or not, as i am not convinced by the email send by CIO as they have mentioned clearly if u get NER at CIO level u will get full refund and i am pretty sure i got my refusal from CIO level. So please forum members help me out if anyone with same situation did get a refund, so that i will be able to fight for the rights of my hard earned money.
