Hi guys so i have got to the stage where i am uploading my different documents for my PR application. Now the thing is, i have claimed points for Family member in Canada and i got 15 points for that for my iTA. but the thing is, i have my aunt in Ontario which who is a canadian citizen and everything but we have the same last name. Im not sure how this is going to work because its now saying it needs to be a biological bro/sis or adopted or step bro or sis? Can someone please give me their opinion. I dont want to get rejected just because of this.

Simple, it is not going to work. Period.

You cannot claim points for an aunt, that only gives you some points for FSW in terms of MEC.

You should have carefully read this as it clearly states that it is a sibling of yours or your spouse's. IF without these 15 points your CRS falls below the minimum score for the draw in which you were invited you should not even bother to apply as your application will 100% be refused.

If it does not, then you should upload a letter in the field assigned for this purpose explaining that you had misunderstood and that you've realized having an aunt will not give these points. They will proceed to deduct these points and recalculate your score and make sure it is still higher than the lower for your round and proceed to assess your application as is. Provided everything else is okay you should be fine.

What is you current score? and what was the cut-off when you received the ITA?

I know..thats why im confused. The thing is we all grew up in a joint family and she is like my older sister to me so i never thought about the biological part.
The cut off score when i got it was 437 - my points were 434 and with the extra 15 it got me to 449. I can decline the ita and go back in the pool, but not sure if the score would go down any more. Im confused. Do you think i can attach a LOA to let them know we all grew up together? But i know its not off compassion and that stuff doesnt really matter to them.

I have friends and cousins that I care for and think of as siblings. You cannot appeal to this kind of subjective things to try to sneak 15 points towards getting an ITA.

There is really nothing to be confused about, you are not entitled to these points.

IRCC's definition of sibling-->

Sibling (brother or sister)
For Express Entry, a sibling means your brother or sister related to you by:

  • blood (biological):
    • brother or sister
    • half-brother or sister
  • adoption:
    • adopted brother or sister
  • marriage:
    • includes a step-brother or step-sister who is not related to you by blood or adoption and your parents are married or in a common law relationship
    • this is true on both the date you submit your profile and when you submit your application for permanent residence
To get points for having at least one sibling in Canada, they
  • must be 18 years old
  • must be a citizen or permanent resident of Canada
  • can be the brother or sister of your spouse or common-law partner who will come with you to Canada.

Your situation is very simple and straight forward and there is no way you'll get those points., because you simply don't have a sibling meeting those conditions. Having someone who shares your last name or whom you love as a sibling won't make it.

You can apply sure, but your application will 100% be refused and you will have just wasted some money, time and hopes.

What you should do is just decline the ITA and wait for another ITA with your actual score. If not you can always work to improve your score or explore different alternatives.

If you move ahead with ITA and claim your aunt as your sister, best case you'll end up with a refusal. Worse case scenario you'll end up with a refusal and a 5 year ban from Canada for misrepresentation.

Thanks. i will decline the ita today. i just have another question, when i came to Canada i was 18 years old. So obv i dint have a full time job back home but i did work as an intern for 1-2 months at 2-3 companies, i want to see if i can claim points for my foreign work experience but it wasnt anything serious. do you think i can still include that stuff and maybe get some points? As far as i know, it has to be a total of 1 year right?

Yes, but in all honestly in really doubt IRCC would consider internships as qualifying skilled experience. You should look further into this, maybe browse some post or IRCC's webpage. I highly doubt it though.
