Need Help

I started working Under NOC: 0621 On December 05, 2013
My Work Permit Expired on October 02, 2014
After that, till date I am working under Implied Status with same employer under same working conditions..

I have 2 Questions..??
1. Can I apply under CEC after 05 December 2014 ..?
2. Time I worked with same Employer on Implied Status ...will be counted in One Year Experience or my application will be rejected.?

I already have IELTS results with me With 7 bands.

Hi,

1. Yes if you are still under implied status by then.
2. Experience gained while on implied status will be counted towards your application.

So That mean I need to be on Implied Status till December 05, 2014 ..??

If they put me on Restoration .. then also I can apply for CEC and what will be my VO ...? CPC-O or Country of Nationality.. ?

Yes you would have to be on implied status till then.. Else you won't be able to qualify with required experience..
If they put U on restoration they would probably give U a visitor status.. All CEC applications goto Sydney.. VO office will only come in if U need a visa to travel to canada once PR is approved

Implied Status has been discussed a lot in the forums. There are two school of thoughts:

1. Implied Status is only counted, if the WP application gets approved.
2. Implied Status inherently is treated as a WP, and you can count that experience towards CEC one year CAP.

Now, I can't safely say that either option is correct or wrong, but depends on the VO that processes your application.

Yes, go ahead and apply. My feeling is that Implied status will count specially reading OP-25A: http://www.cic.gc.ca/english/resources/manuals/op/op25A-eng.pdf

Copied from above section 10.11:

"Note: Work experience acquired while under implied status will be considered as eligible work experience under the CEC, provided the applicant continued to work in Canada under the same conditions as their original work permit until a decision was made on their application for a work permit extension."

The one detail you left out - did you apply for a new work permit before October 2, 2014? If not, then you are not on implied status.

You can apply, whether you are eligible or not. If you are on implied status, then the time should count. It is true that in the past, implied status has been refused when the work permit application was deemed frivolous - e.g. you know you need an LMO but apply anyway without one, just to extend your time by a month or two. Have not heard any reports one way or another since the OP 25A was updated - let us know!
