Hello, my name is Conrad Worth.

I am asking about spousal sponsorship for my wife. She is from the United states of America, and I am a resident of Canada. We've been dating online for 5 years, and she has visited 3 times total. She stayed for 6 months earlier this year.

She had to go home for a surgery and when she got to the boarder, she was allowed in with a 1 month time limit.

We are wondering, if I apply to be her sponsor, can she apply at the same time for sponsorship and would she be allowed to stay until the process is finished? We're just looking to be able to have her stay and not step on any toes or get us into trouble/prevent us from living together in the future.

If you sponsor her inland and include and open work permit application AND the application package reaches CIC before her 1 month in Canada ends - yes, she can remain in Canada while the application is being processed.

From what you described, I don't think you can sponsor her yet. You either need to be married or to be in a common law relation (12 continuous months of cohabitation) to sponsor. Dating doesn't count for immigration purposes.

She can apply for a visitor status extension and you write her a letter of support saying you will support her financially. But if you never reached 12 months of cohabitation with her, your count restarted from zero the last time she came back to Canada, and you must reach 12 months to sponsor as commonlaw. If you get married, you order the marriage certificate and as soon as you get it, you can apply.
