here is the situation:

My wife is PR in Canada.. we have 2 kids(both canadian citizens) .. one is 2 year old and other is 5 months old.. My wife has 1 more year that she can stay out of Canada and keep her PR status active (as she have lived outside canada for 2 years in her previous trips to Pakistan). she sponsored me for immigration in March 2012 and we are stage 1 approved in June 2012.

Now question is..

I want that she comes to Pakistan and stay here for 1 year while my case is in process in CHC Islamabad. But I also know that for PR it is must they stay in Canada while their spouse's case is in process.. I want to ask if she comes here and my case is refused.. will we be able to appeal and will they realize that it is a genuine reason that a father cant stay away from kids for such a long time i.e 30 months (4 months for stage 1 + 26 months for stage 2) ?

I also want to ask that Canada claims it wants to reunite families and they care about human rights.. why they didnt make it easy for couples to live together? I am not asking to process my case fast.. but atleast let the spouse live here in pakistan while case is being processed... SPECIALLY if couple have kids... cant they realize this? If process was just 3 or 4 months long then it wud have been ok.. but for 3 years? :o
 
A lot of other people have the same problem but rules are rules. Your wife can go talk to her MP in Canada and complain about how slow Islamabad is and that she as a PR is forced to stay in Canada throughout the processing and the Canadian citizen children are deprived of their father in the meantime. Maybe the MP can pull some strings, who knows. Have you tried applying for a TRV yourself? You could do that. You could also apply for a TRP on H&C grounds but I can not tell you what your chances are. However, if immigration finds out that your wife is not residing in Canada and refuses your application based on that, there is not much you can do to appeal except to try to prove that they were wrong and that she really was residing in Canada.

Some people have stayed outside and gotten away with it and some have been caught.
