I’m applying for a Canada Study Permit (outside Canada) and received two consecutive Procedural Fairness Letters:

1️⃣ PFL #1 – Claiming I didn’t declare a U.S. visa refusal.
➡️ I submitted an LOE explaining I never attended any US visa interview and never received any decision. I also attached confirmation from US Embassy via email that they have no record of my application since the validity of my passport.

2️⃣ PFL #2 – Now claiming I didn’t declare an Australian visa refusal.
➡️ I only have one Australian visa ever — Visitor Visa (Subclass 600), granted on 12 Oct 2022 after biometrics on 10 Oct 2022.
➡️ Never applied before or after, never refused.

I already submitted LOEs with:

  • Visa grant letter (Australia)
  • Biometrics confirmation
  • VEVO record
  • Application form declarations
  • Privacy Act request to Australian Home Affairs (pending confirmation)
Has anyone successfully passed their application after receiving PFLs for alleged misrepresentation when it was actually a system error or mistaken identity?

And I don't know what will happen to me next, I'm really nervous

Nothing to do but wait. You have submitted what you can.

It is not just a refusal during your current passport's validity but your whole life. So if parents applied when you were younger and refused, you must declare it. Sometimes applicants don't know parents applied for visas on their behalf until they get PFL.

For the first one, you would need confirmation from the US Embassy that they have no record of an application for you ever, not just on this passport. If you previously applied for a US visa but did not attend the interview, that would have resulted in a refusal on your record. Did you apply but not attend an interview in the past?

For your Aussie visa, I would check if it was ever revoked without your knowledge. Have you tried contacting Aussie authorities?

Actually it never happen that my parent applied for me as they are Vietnamese and we have no relatives in other countries. But the point is that I don’t know how to prove. I have already submit FOIA to US Embassy to get an official record of my visa history but it takes long time

For the first point, I have already told them if I have any record of application, and they said no.

About Aus visa, I have requested an FOI also and still waiting for the Home Affairs as this process takes 30 days

Then you submit what you have with explanation letters. There are no timelines for PFL. Can take weeks or many months. Getting 2 PFLs is highly unusual. If school starts in January may need to defer.

Thanks for your advice! I have already mentioned about that on my explaination letter. I don’t know they accept it or not, but after that they sent me the 2nd PFL about Aus visa refusals

Canada, US, UK, AUS and NZ (the 5 Eyes) all share immigration and security information so there is no hiding from refusals. There can be an error if your name and birthdate matches with someone. Also many times parents will say they never applied for any visas (of any type) in the past but don't mention it to their children. Parents don't think the information is important but then will say "oh yes, we applied for visitor visa when you were an infant" and forgot about it.
