NEED HELP! Petition for custody etc in Philippines

hello everyone! i have few questions regarding my status right now. i applied for PR 3yrs ago after finishing my contract, i have always been the sole provider..i sponsored my hubby and 2 kids, to make the long story short, he became unfaithful and i decided to leave him. the problem started when he alienated me from my eldest son in 2011, he wouldnt let us talk over the phone, when i tried i would just hear him screaming in the background. my family back home even tried to go to my ex's house to visit my son and borrow him but to no avail. so when i heard that my ex went to Dubai, i went back home last MAy of 2012, i couldnt find my son, i know the place where my son lives but he wasnt there, i was concerned with his safety coz at that time he was only 10. so i went to DSWD and sought help so we found him in Bulacan..my ex entrusted him to his uncle, my ex knew my mom's place in cavite, they did not even bother to informed one of my family members. So i asked for a lawyer's service and filed for petition for custody for the two and SPA for my mom..so my kids are with my mom now. my problems are, what supersedes an SPA? what if my ex comes back home and get my kids? i have talked to my lawyer just recently and he said that eventhough the custody wil b granted on me, or if i file for annulment i still wont be able to bring my kids here without my ex's consent, and that i should talk to him..what's the best thing to do? should i file for Solo parent? file for legal separation? apply under refugee claim to get my kids here? coz im afraid of him and his threats and his family back home..pls help..i just dunno what to do..i just want to bring my 2kids here..thanks for taking time reading my agony..this forum does sure help in easing my burden..i wil greatly appreciate a reply or a an email tnx alot God bless us all
