Hi, i am a american citizen married to a canadian citizen. We married November 18th 2011 and this year he filed for taxes and claimed me because i have no income. He recieved his taxes. Is this okay? Also Now my husband is having a hard time getting his GST Checks because they want my Social insurance number. I dont have a social insurance i am an American applying for permanent residency. I have a social security number. Can anyone tell me what is the problem?

The problem is CRA is filled with idiots. Write them a letter with the following information:
Your name
Your SSN
Your income for 2009, 2010 and 2011
Add in proof you applied for PR and proof you're from the US. We had the EXACT same problem. It got to a point where they told me I had to send them my ENTIRE application, so I did. It finally clicked in their heads that my husband is NOT Canadian and NOT working. It was annoying but it's what kicked them in the head.

What do you do if you are American working in the US and your husband is Canadian working in Canada? Do they have a "married filing separate" form like here in the US?
 
I am in this exact same situation, I think the problem is the CRA believe you are working in Canada. What your S/O should have done was just filed your sin out as 0000-000-000 but declaring you on that form has raised flags with the CRA. I don't know if this can be corrected by a phone call but just about to find that out in the next few weeks.

Such a pain on top of immigration I now have CRA chasing us and I have not worked a day in Canada in my life lol :D
 
Hi, first of all, you need to fill out the form RC65 (you can find it on CRA website) and send it with your tax return, and be careful in the tax return that you do not claim the basic personal amount of your spouse on the federal income tax return unless you've been financially supporting your spouse, and just claim your own GST credit, not you and your spouse since she's not in Canada yet, and after she lands Canada, she needs to fill the form RC151 to apply for the GST credit.

For quebec tax return, the qc gov allows you to claim the basic personal amount of your wife even she's not in canada yet.

When you file your tax return, just write a note that your wife is not in Canada yet, and leave her SIN 000-000-000

That was a post, posted in 1 of the other forums by a professional accountant. Once you have been declared on that form CRA will investigate lol

Your husband has to claim/declare your world income for the past three years.
 
When filing the spouse who is filing in Canada SHOULD BE filing the return Spouse: US Resident/ UK resident (whatever country)

When your S/O declare your world income that is what creates the problem. Unless your in Canada with a SIN you should not be declared on your spouses form.

That seems ridiculous but maybe I just don't understand. What does what I've made over the past three years matter to his taxes? We didn't even know each other three years ago. Luckily he has a good accountant, I'm sure he will figure it out. :)
 
Being married legally is not same as being married for tax purposes. If you have never lived with your spouse you would not considered to be married for tax purposes.

I didn't get it either. They asked for the past three years for my husband, sent that. STILL asked for his SIN. Sent them three letters and finally I was PISSED OFF and called them AGAIN and explained AGAIN that my husband does NOT have a SIN does NOT have an income and how in the world can I get it so I don't owe them 200-500 dollars?! ... I was not happy. Finally they told me to send the entire application (copy of) and it should be enough proof. It cost me 17 dollars to send it to them, but they finally sorted it all out on their end. It made my life hell for four months trying to deal with them. So glad I don't work for CRA or I'd be yelling at the top of my lungs at my bosses!
 
Yes IF you have supported your spouse then you are right and even then there is a certain threshold that activates it. I said in my post above clearly IF you have not provided financial assistance then you should just be filled out as a spouse with a default SIN 000-000-000

Once your S/O declares you that immediately raises flags to CRA.
 
Your so right! they are Morons. the lady was telling my Husband to make me apply for a social insurance number when i specifically told her that i am not allowed to work or go to school i am still a visit and in the process of applying for permanent residency she insisted that i go apply for a social insurance number. First of all shes dumb because thats against immigration rules and second of al how can she tell me to go get something i am not able to get. thanx for the advice!

We must have gotten the same lady. The first time I called, I got the same anwser. I believe I told her to get me a manager and she said there wasn't any around right now and that I'd have to deal with her. Told her she should look up CIC immigration laws since she has no idea how to do her job correctly. I hung up, called back, got a guy and he's the one who told me to send a letter. *sigh* it's annoying as hell. Just send them everything I did and it'll help, and maybe it won't be 4 months before they figure it out haha.
