Hello,
my work visa will expire! I want to apply online for visitor visa!
How many days before my work visa expires do I have to apply???
and I heard I could stay anyway 90 days after my Work visa expires? ... or only if I applied for a visitor visa?

what happens if I don't get the visa? Can I go to the border to get it ( I am from Germany)

I am writing this from memory so i COULD be mistaken and before counting upon any of this seriously, you better recheck - this info is written on CIC website.


If your work permit has not expired yet and you submit an application for renewal BEFORE expiry, you are under implied status, which means you can continue to work until you receive your decision.

Once you receive a decision and if is a refusal OR if your work permit expired and you haven't applied for renewal, then you have 90 days to apply for restoration of status. During this period, you cannot work even if you applied after the expiry of your work permit although you can stay in Canada until either you get another status or 90 days pass, by which you have to leave the country.

UPDATE:

I checked that german nationals do not require a visa to visit Canada which means you could stay here for six months on one entry. But you cannot work. Also i am not sure how does that apply to the fact that you were already here and your wp expired. Probably the six month relaxation would not be available in this case. But i am just reasoning out of my limited knowledge.

Why don't you thoroughly read CIC website and on top of that use CIC HELPLINE NUMBER TO CALL. You might have to wait 15 min or so to get through in working hours, but they do receive calls and respond. Try that.

CIC advises applying 30 days before expiry, though you are able to apply up until the day before your current permit expires.

If you stay in Canada without extending your status, you will be here illegally when your work permit expires. However, CIC offers a 90 grace period for you to restore your status and become legal again. It is a better option, and cheaper, to just apply prior to your permit expiring rather than apply after becoming illegal. If you apply for the visitor visa prior to your work permit expiring, you will be on Implied Status after your work permit expires until CIC makes a decision on the visitor app.

Provided you can show sufficient finances, it should be approved. On the off chance that it's refused, you would be told to leave Canada. There is little chance that going to the border would do you any good after being refused and told to leave Canada. You would need to actually leave for a bit.

what happens if one applied for restoration within the 90 day grace period and does not hear back.and in the meantime the 90 days also expire?

You can remain in Canada until you receive a decision on the restoration request.
