I am a PR and have submitted an application since March 2018 to sponsor my wife who is outside Canada.
Our application was just sent a week ago to Canada visa office in Cairo (Egypt) to complete the assessment.
We received yesterday an email from Cairo office that we do not meet the requirements because of our proxy marriage and we only have 60 days to provide additional information

Question:
I know that the only solution may be to re-conduct the marriage with both of us physically present, but:
1. what if we do that within 60 days, would they accept the new marriage certificate with the new dates?
2. If not, what would be an effective/sufficient document/information to get our application approved without being rejected first?

P.S. We have replied twice to their email asking those questions but they haven't gotten back to us yet. They also will not answer our questions over the phone, only emails are allowed.

I advice you two should get married in person within 60 days. And take pictures!!! And send those documents before the 60 days.

I am surprised that you didn't see this proxy rule. Proxy marriages are not accepted form of marriage proof for IRCC anymore. This rule has been in placed for a while now.

You can sponsor the person as your spouse if your marriage is a legally valid civil marriage.

Opposite and same-sex marriages:

  • will be recognized for immigration purposes, where the marriage:

    2. if performed outside of Canada, the marriage must be legally recognized in the country where it took place and in Canada.
Note: IRCC no longer recognizes marriages performed outside of Canada by proxy, telephone, fax, Internet and other forms of marriage where one or both persons were not physically present at the ceremony. For more information, see Operational Bulletin 613.

They will probably refuse the application, even if you get remarried, as you did not qualify on the date that your application was submitted. The 60 days is allowed for you to demonstrate that they made an assessment error, which they obviously didn't. It's not so that you can "fix" the flawed application. However, good luck.

We are working on that now. However, the Egyptian law enforces us to get divorced first in order to re-issue a new marriage certificate.
Do you know of any workaround to make a new marriage? like can we do a civil marriage at Canada Embassy in Egypt?

Hi Manny, we had to re-conduct a new marriage certificate in Egypt. That was the only solution we could find based on the Egyptian civil laws.

The Canadian Embassy does not conduct marriages.
