Hey guys,

I'm super confused.

I'm currently waiting for my spouse PR in Canada(I have a file number, and it's under processing).
And my visitor visa got expired a few days ago.

Do I have to restore my visitor visa? Or Am I eligible to stay in Canada on implied status?

Yes you do. Spousal application does not grant you any sort of right to remain in Canada.

Thank you so much for your prompt response.
Does my expired visitor visa affect the my PR process? Or is it okay to restore my visitor visa in 90 days?

Assuming you submitted an Inland application (SCPLC), you technically do not need legal status; there's a Public Policy that's been in place for years that waives the requirement, BUT...It's still advisable for you to restore your visitor status, because it's just plain smart.

But without a valid status, OP cannot apply for OWP even after he/she got AOR.

Agreed, which is why I said "...because it's just plain smart." Those without status need to wait until they have AIP.

Having said that, I wonder how any Inland applicants have actually received their OWP before getting their PR?
