My Study permit is denied but I got ITA

Hi friends,
VERY IMPORTANT< PLZ suggest.

My permit extension is refused but I got ITA. If I apply for PR from Canada Can I stay here till I receive it or its best to go apply for PR and leave to INDIA?

Please this is important. I DID not get any info or dead line to be here. am going to consult that with the ORG who processed the paper. Please advice on this. Thanks !

Applying for PR does not not authorize you to stay in Canada, and you are not required to stay. In fact, if you are not authorized to stay in Canada, you should leave. Staying in Canada without authorization (illegally) could result in your application being refused.

You don't state if you have any current valid permit, only that your extension was refused. If you have no valid permit and do not plan to apply for restoration + other permit, then you should leave ASAP. You have a 90 day "grace period" during which you can apply for restoration.

thank you so much. Am planning to apply for restoration but I the Immig am processing seems interested in money. Am not sure wtr its best to apply for restoration saying I applied for PR & waiting for the result or leaving & processing my paper from abroad.

My current Situation is am in implied right now!

You could apply for a BOWP if:
- you have a valid WP
- you already sent the PR application and got AOR
- the BOWP is granted only after R10 check

If you're out of status you cannot apply for BOWP.

Unless you have a real chance for restoration (like a mistake in your previous student permit application) it will be better leaving the country (after get all the documents for PR or even submit your PR application) before the deadline (be sure border offices record you're leaving)

If doubts about restoration your safer shot is leaving the country to avoid issues with your PR if over staying in Canada (be sure to get all the docs you need for PR or even send it but providing your abroad address)

If you are planning on applying for restoration, then you don't have implied status - you are in Canada without status (you're out of status).

I already have PC from September 2016. Thats my biggest concern!

No, you are not on implied status right now. You are out of status.

On what basis do you believe you may be eligible for a new study permit or work permit? You haven't stated anything yet that indicates you are eligible. Or are you talking about a visitor's permit?

It is simply not possible for us to provide any useful advice if you cannot provide us with relevant details.

if your current student permit has expired and you have an AOR , then you can apply for your study permit to be extended if you all the necessary documents from the college/university.In case you finished you degree and currently have a open work permit with the AOR you can apply for bridging open work permit.

Restoration is all together different ball game. Say you over stayed your permit and still under 90 days after expiry you are eligible to apply for restoration.Restoration of your current status i.e either student /worker.But in this case all attach all necessary documents from college/univ if student , if have work permit then just write a letter to the officer explaining the reason why choose to over stay and let them know you have been in pool since your permit expired and was looking forward for my application to be picked.(i was in the same boat i had to restore my status , i wrote a explanatory letter and submitted my application and was granted the work permit in 20 working day no issue.)

If you want tobee-apply for WP you haver to apply simultaneously for Status RESTORATION and WP, filling out all the forms and paying all the fees.

Do you think this time your WP application will be approved?
Do you/your company fixed the rejection causes?
Are you absolutely confident on it?
If yes you could consider applying before the 90 days since you were notified about the rejection (please, double check your deadline)

Otherwise your best chance is leaving Canada for a while
