Hello everyone, I sincerely need some guidance here. God Bless.

My wife and her whole family are currently under the refugee program in Canada with my son who is a Canadian citizen by birth.
But I need to apply for express entry to join my wife and my son.

I would like to know if EXPRESS ENTRY will work, but more importantly, if I should apply alone, or I should apply for them with me together.
We and my wife both have our WES and IELTS ready, though the CRS score is not high enough and I intend to go for Provincial nomination.

NOTE:
* She has already declared me as her husband, and she and my son carry my surname.

** I was rejected a visit visa before she left with her family.

*** I am concerned that if I apply for her with me, which means if I am selected on the express entry PNP, she would probably have to exit the asylum claim come back home and summit the international passport at the Embassy.

**** I am thinking if I should apply alone, the question of why are you going alone might arise, without your wife, what would it means if they discovered that my wife is under asylum in Canada already.

All in all, I would like to know which would make sense and why, to apply alone (as not coming with a spouse) OR to apply as I am coming with spouse,
and to suggest any relevant input and guidance.

God Bless!

If you apply, you are legally required to include your wife and child in your app. There is no choice about that. Failure to include her is misrepresentation. Including her doesn't mean she needs to withdraw her refugee app.

When did you get married? When did your wife get protected status in Canada? Did her family apply for asylum on Canada or did they already receive approval in their home country?

We got married early 2019, she went with her family after about 6 month. They applied for the protective status inside of canada and awaiting hearing now.

Okay, thank you.
But assuming I don't want her to leave the refugee program just yet, and I want to just run thr Express entry alone, I could simply say I'm not coming with spouse right.
And would it be proper to say I'm not coming with spouse even though she is already there?

Again, including her doesn't mean she has to withdraw her refugee app.

You can include her as non-accompanying.

This is all moot at this point anyways, since your score is far too low to qualify.

Were you already married when she applied for asylum?

If you are married your wife and son should not be applying for asylum with her parents.
