OP should be focusing on applying for Express Entry - not responding to an application refusal that has no chance of being overturned.

Applicants have to meet the language criteria at the time they apply. The OP didn't and the refusal is justified. CIC won't reconsider the refused application.

Again, the OP should be focusing on applying for EE.

and why you paid the RPRF, then rejected?

and what's your work permit type . close or open, and if you have LMO with NOC or not ?

Actually, I am thinking, this kind of refusal is really really tough.

because they can say all the B application case falling in A ( their NOC code have lots of overlap duties ), then IELTS is not satisfied , then reject .

it sounds like, the VO is trying best to reject a case he/she doesn't like . So it is not difficult to find a reason to reject it, but not telling the real rejection reason.

we'd better check the the duties if have some obvious mistakes to lead this result.

Agreed. The rejection reason looks very unfair. Also the OP wasn't given chance to address the issue (no fairness letter has been sent).
I think it worth trying to consult with a lawyer if there is a place for appeal.

I sent a detailed email to cic yesterday, but the mp's office told me usually they won't respond and the decision can't be over turned .... My fate , but cic is so cruel and there are no enough grounds for this rejection , it was unfair, they just said technically I fall in the A category not B and then rejected saying the IELTS was not enough, for one module I have only 5.5, is there a number I can call cic?

something should be clear : do you have close work permit which only allow you work NOC A . because in that way, the case rejection chance will be increased.

and what's the duties you used to apply, why it will more falling in A not B. this should be checked again carefully, because, you can't change your duties for same application.

but you can explain it instead. so let's have a check how to correct the understanding of VO , let him/her to agree , your major duties is B not A.
 
I, too, tend to think this NOC A or B issue is pretty subjective. Many of the NOC B duties overlap NOC A duties in high-tech/IT jobs, so it's really up to your VO to decide overall the job is A or B. I'm not sure if it's bad luck that the OP met a strict VO, or they (CIC) are intentionally tightening up on this issue.

Obviously, reaching IELTS band 6 in all categories is a sure way to be safe...

I searched the rejected case, for IELTS update, someone once tried and CC to MP , but doesn't work.

I found one case passed again , but he tried to convince the VO , the NOC is B not A , by CC to MP .

For EE, you can apply , but in which period, you get your job experience . and how much points you can get in EE system,

you have to know, in EE, apply doesn't mean they will "choose" your case as previous CEC program .

it seems like , you apply a school, the school only choose the best students. hope it is clear.
