please help. my application got rejected today. The reason they said, I applied in the B category, but in fact i belong to the A class, and the language score was the problem. The GCMS notes didn' t mention anything about that...my fate..after waiting 13 months....hi guys, i have a question. Can i do anything at this point? Is it possible that the MP's office can do anything in this regard. They said my file will be retained for two years, can i re-do the IELTS exam and submit the score.Any possibility plz help.
 
sorry to hear that, I am not a experienced guy to comment on this but you can apply under EE

Since your file has been rejected, you'd need to start a new application with new documents from scratch.

Unless the VO made a mistake... I'm pretty sure I saw a case in this forum where a rejected application was re-opened and approved in the end. The OP's case is not similar to that one, though.

So sorry about that. So, the case was rejected after medicals.....is it??

I'd say that's a very rare case and since a valid reason of rejection was given - it'd be difficult to make such claim unfortunately.

You have to meet the requirements at the time you apply, you cannot change IELTS scores after you apply.

But you can certainly retake the IELTS and re-apply - good luck!
 
You mentioned that GCMS notes didn't show it, but there is 1 section that states if you have "met" the required english level under you NOC. What does it say in your case? Maybe the whole confusion happened because you have used a wrong NOC code, so the VO thought that you met the requirements. Unfortunately, you'll have to re-apply under EE from my point of view.
 
I'm not saying this is what the OP did, but applicants with NOC A occupations sometimes can't meet the IELTS requirement for skill level A jobs, and have been known to try to "downgrade" their work experience by trying to use a B-Level NOC. VOs are on to this trick. At the very least, it looks like this is what the VO suspected...
 
In my opinion write ielts immidietly without wasting any time and send them an email with explanation

You are right , in the GCMS notes it was mentioned that the benchmark is bet for B category for which its applied, but in the rejected documnt they said my duties show that I fall in the A category and therefore it's rejected..... My fate so now can I apply in the express entry ?

Since it is rejected, will writing an email asking for a short duration to submit the IELTS will help! Are you aware of anyone got a second chance like this.
 
I would suggest you to search carefully this forum. There was another rejection which turned out pretty well (if I remember correctly). Basically, you'll have to demonstrate that your duties are falling in NOC B somehow (probably another employment letter stating your duties correctly from your employer). Try finding an immigration lawyer immediately. However, if you're certainly NOC A, I think you can't do anything. Best of luck!

What is harm in giving it a try?
