Ok so long story short I left the country for the day and came back because I had overstayed a visitor visa for 4 months and need to apply for a work permit - previous plan was to apply for common law, relationship broke down etc etc

My lawyer said I can apply for an extension with this - but the IO said he will put a note on saying to refuse it. I am eligible to apply for a particular work permit; I have a business here (which I do not work at) and am starting a new business which I will want to work at.

So my lawyer said I should apply for an extension, just be very honest and apologetic with my explanation letter and then a week or so later apply for the work permit.

Can anyone give me some advice on doing this? I was planning on going to the states for 8 weeks to wait out my work permit - would this be more favourable to me because I left when told - or would it be fine for me to do the extension?

I think you were lucky to be allowed back into Canada after a four month overstay and leaving for only one day. I would forget about the extension and wait out the processing of your work permit outside of Canada.

Which particular work permit is it that you qualify for?
