MOTHER SONSORSHIP - LEGALLY SEPARATED FROM FATHER

Hi guys,

My mother and father have been separated fro over 10 years and have had little to no contact. My father is stubborn about not divorcing my mother for fear of having to part with his wealth. My mother has given up on that cause as the court system in India will not lead to anything.

My question is: Does she need to add my fathers info as a spouse. She will be mentioning that she is separated from him, and get an affidavit stating it. Any thoughts? Thanks a lot for your help!

As far as I understand it, yes, she would need to add him as her spouse because he legally still is her spouse. She can note that they are legally separated and have been for 10 years, but he would still be her spouse.
