hi everybody! (in a dr. nick voice)
first off, i want to thank everyone here at the boards
i joined during our process, and all of the information and responses
here are very helpful, so know that all of you sharing your
experiences are truly appreciated!!!
the process with myself and my girlfriend hasn't been really
long, but stressful none the less...
we met on cruise ships, and spent 5 years together sailing
the seas, until we decided we were finished with it, and the last
time that she tried to get a temporary visitor's visa we were
rejected (twice) very shortly after the new visa requirements
were imposed...
anyways, we applied for permanent residency for her, we are not
married, but it was suggested by the call centre that we apply
as conjugal partners as it would seem "strange" to get married and
apply right afterward... i have read how difficult it is to get a conjugal
partner as a permanent resident, but went with the advice they gave me..
so, the reason for the post, i recently got a letter saying that i
have qualified as her sponsor, and the application has been sent to
mexico city. We have plenty of proof of our relationship in fact
she is my niece's godmother, the only part we were fretting was the
fact that she was my "conjugal partner"..
has this speedbump been passed? or will the conjugal partner issue
still weigh in with any decisions made in mexico city?

The sponsor approval stage confirms that you are eligible to sponsor (i.e. aren't on welfare, aren't bankrupt, etc.). This stage does not evaluate your relationship.

So the short answer is that your conjugal relationship hasn't been reviewed yet and will be evaluated once the file reaches Mexico.

They haven't yet looked to see whether your conjugal partnership is valid. Once it gets to Mexico City they will be looking for evidence of whether you have really been in a marriage-like relationship for at least one year, rather than in a boyfriend-girlfriend relationship. It depends of what supporting evidence you sent whether they conclude that on the balance of probabilities you have already been living as a married couple would (though you haven't been living together, or at least not all the time).

I sort of disagree about the advice that should shouldn't have gotten married then apply right afterwards. It would be perfectly fine as long as you can show the development of your relationship up to that point and that it wasn't a married arranged primarily for immigration purposes.

Hi Matt,

We are going through the same stressful process. My partner has his interview next week and then we will see how they evaluate it overseas.... To me this is where the system is a bit flawed and laws and guidelines contradict themselves.....but lets hope for the best! Good luck to you guys....keep us posted!
