Hi.
Got all police clearences ready to add to my spouse sponsorship except one from my husband's 21yo.
The dependant will be non accompanying, lives in the UK and we had no contact with him for a few months. He is aware that we need this PC but it is taking longer than expected. I wonder if i can send the application with a statutory declaration stating that i am working on getting one. Anybody did this without having their application returned?

Apps have been returned for not having PCCs, while others have not been, so it is your own risk to take.

A UK PCC can be done in 2 days if you pay the higher fee. Is the issue that he doesn't want to co-operate? Did he do the medical?
 
Yes his brother did one really quickly in the Uk. The problem is that we have lost contact with him for the past 2 months. So i guess he isn't cooperating. No medicals has been completed yet but i thought this was requested at a later date.

If he has cut contact, then your best option is to apply and request he be excluded. Your husband needs to get a notarized declaration stating that he understands that his son will be forever excluded from the Family Class and could never be sponsored. He needs to explain that his son is a 21 year old legal adult that has refused to co-operate and has cut off contact. Show proof that he has been trying to contact him, like calls/email/chats/texts. If your husband has the birth certificate or other proof of age, include a copy as well.
