My husband is in Canada since last 4 years, studied and working and is a permanent resident, we got married in Dec '15 and applied for our PR on Jan 4 '16, we have got our sponsor evaluation finished and the file has been sent to New Delhi Office. He has a bought a new house and the house warming was on 28th March, and I applied visitor's visa a couple of weeks back through an immigration lawyer in Canada. I did specify each and everything honestly, including my employment, to which they claim as "misrepresented", I asked in my office and got to know that the calls were made on odd hours and it was attended by a Field Boy and he responded that "I used to work here", both the times the calls were attended by him and my job was verified and confirmed by the same person all when the receptionist wasn't on her desk and that too a field boy(since no one was in teh office at that time). Hence, we have got 30 days time for explanation, trying my best to get each and every document. But, the question is should we withdraw the TRV application giving explanation so that we avoid any harm on PR or are they going to anyway stop me to come to Canada for 5 years and automatically brings my husband out of Canada. ( No couple can live apart for 5 years) :(

P.S.- I am a resident of New Zealand and a citizen of India and in India from last one year.

Withdrawing the application most likely won't stop the misrepresentation finding. You need to provide CIC with proof that you do in fact work there. Have your employer write a letter explaining the field boy's mistake and confirming you do in fact work there, provide pay slips, show your bank statement where the pay slips are being deposited - and anything else you can think of to prove employment.

We are planning to provide an explanation and give proofs, salary certificate, salary slip, declaration from the director and the owner. But withdrawing makes more sense or continuing with it? Cz the lawyer says to withdraw so that there are less chances of harm to PR. Whether the visa officer is convinced with the proofs or not is upto him/her. Searching on the net one finds that rarely they get proved.

Withdrawing has risk as well. CIC may still make a finding of misrepresentation and issue a 5 year ban even if you try to withdraw.
 
All documents are ready including a letter from the director about the mistake of the field boy, everything. Any chances of positive hopes? evidences? similar case? Why would one lie for a visitor's visa if PR is in process.

This is utter nonsense. Your right why someone will lie about themselves when they have already filed for the PR

Also did you hue the bank statement and the job letter in the first time ??

So since how much time are u in ur job ??

I am sure u ghouls wait for the AOR 2 and then apply as then ur spousal visa file would have reached India

So that they can verify with that as well
 
Sorry didn't know of the abbreviation AOR! File has reached Delhi! Dec end we applied for PR, my job is 2 months old, job i started in jan! We have got file number as well! I started work after submitting PR application!

Are you sure that they called at ur office ?? As this has never happened to anyone. !! And Canadian embassy in India will function at Indian times so why would they call at odd times. So did they mention this in the reason ?? Through which vfs did u submit ur docs ??
You should not withdraw ur file according to me but take opinion from seniors

hey that's ok even I was new some day but now I am familiar with the terms

AOR means acknowledgement of receipt which first we get it from Canada, that one is for the sponsor and the second one we get it from India which is for the principal applicant

Well 2 months job is fine I guess till u submitted everything

may be there could be similar one under ur name worked before! its better to clarify the misinterpretation. As Scylla said, what if they put a ban in case of withdrawing the application? if u have proofs, try to explain!

This is insane! this is the first time I heard that someone from CIC calling the applicant's employer to clarify their employment status, maybe because you are applying for visitor visa? Well, if you only applied for PR then they will not call your employer because you don't need to provide the number in the form.

If I were you I will provide documents such as letter from the boss, salary slips, employment certificate and any documents that will make your application very strong. Please take note that if visa officers will know that you misrepresented something in you application, your PR application will be affected as well and that is 5 years banned in Canada :(
