Hey all,
I'm still pretty early on the stages of this extensive process and i have questions about the medical exam and dependants. My husband (US citizen) has 2 children from previous relationships who will not be accompanying him to Canada, as the mothers have custody. I did add them to the application as his dependants but i would bet my life on it that they will never want to immigrate to Canada but just added them cuz it said i had to.

It is only those who are going to accompany him that are required to have the medical right?

And is it absolutely neccesary to have his kids on the application?

No. All dependent children, whether accompanying or not, have to be medically examined to preserve the right of sponsorship at a later date. It seems like a pain in the a** right now but what if something happened to their mom? Or they wanted to go to university in Canada? You never know and CIC wants to ensure that all of the bases are covered.
 
His kids should be on the application, and they should get the medicals done, even though they are non-accompanying. For 2 reasons: 1. if you don't, CIC really doesn't like it, and will keep asking for the kids' medicals; you can sign a document stating you understand if you don't get the medicals done, you will never be able to sponsor them in the future, and you are OK with that, but CIC really doesn't like it. Doing so will delay your application, and may lead to a refusal; and 2. circumstances change - for example, if the mother dies, maybe your husband will want to bring them to Canada; if they didn't have the medical, then even though he is the only parent left, he still won't be able to sponsor them.

His oldest will be 18 this August and has plans on going into the US military so Canada is not in her future. As for his son he has not spoken to in about 4 yrs and is 16 and we are also certain that he will never want to immigrate to Canada.


So if i do choose to have additional documents, to explain the situation thoroughly, the CIC does look at it?

You don't HAVE a choice. That's the thing. He MUST declare them (otherwise it is misrepresentation) and he has to put forth his best efforts to get them medically examined. Document this by sending emails, letters, even private messages via Facebook! If they refuse to comply, you can submit this evidence to CIC and hope that they will accept it. If they are not medically examined and CIC agrees to continue processing his application for PR, he must wave ALL rights to sponsor them in the future as they will no longer be considered eligible family members for the purposes of immigration to Canada.
 
He will be declaring them and they are in the applications thats the easy part. Its the medical exams that will be a challenge. I already know that won't happen. No way in hell his childrens mother would ever have that happen. He has no problem waiving the possibilty of ever sponsoring them into the country. So future eligibilty will never be an issue with his dependents.

I am in same boat now. Living seprate from depedants . My wife and kids are not accompanying now.

What should i do??????

If you are married with children you MUST MUST MUST list your wife and your children in your application. Declare them as non accompanying and have them medically examined. This will preserve your right to sponsor them later on. Do not try to exclude them from your application and DO NOT misrepresent yourself and try to push your application through faster by not disclosing them to CIC
 
I have declared them in my application and now i have receievd medical request for whole faimly .

But problem is today me not living with my spouse and children. Due to matrimonial dispute.
she has left along with children.
She doesnt wnt to come back . In india Divorce is really tough also ight to see children is limited so i am not planning for divorce.

I also want to gt PR for myelf working on my application from 2 yrs.

Pls help how to proceed from here. I am ready to declare that i understand i wont be able to sponsor my faimly in future.

As rjessome mentioned, you must do your absolute best to try and get the medical examinations. And if they keep refusing, document this and explain it to CIC. CIC will only accept this if you have a lot of proof that you really really really tried your best to get them to take the medical examination.
