Re: Married with the sponsor and have 3 children, husband will not attend interview

If you tell them that you and your husband are getting divorced, they will not give you PR. If you tell them that you are having marital problems at the moment and are just maybe getting divorced, then I don't know. It is they job to make sure that your relationship is genuine before giving you PR.

If you do not get PR through sponsorship, you can look for another way to apply. Do you have full time work in Canada for at least 2 years out of the past 3? If yes, you could qualify to apply under Canadian experience class. If not, you can look into getting a NAFTA visa again and talking the employer into sponsoring you through a PNP or apply yourself under FSW.

If you filed spousal PR and the marriage is broken down or you are not planning on staying together and you both go through with it then it will be misrepresentation from both of you. When he filed, he signed an agreement that he will be financially responsible for you for 3 years so he may be thinking about that as well.
