Married but separated

Has anybody applied through express entry for permanent residency while declaring themselves as married even though already separated with spouse?

Story is me and my wife have been separated since 2022. We dont have any legal documentation reflecting this separation since we dont have any separation agreement or court issued documents. I have prepared documents such as affidavit of separation (signed by me), a statutory declaration (signed by me) stating I will not sponsor her and wish to exclude her in my application, and I have recently filed for divorce but no final decision yet. I am on the early stage of divorce which is filing in court then serving the documents to ex spouse. We also have 2 dependents and I have gotten her to sign the IMM 5604 declaration for minors migrating to canada with non accompanying parent

I got an ITA and submitted my PR application already and still listed myself as married. I uploaded all above documentation together with a letter of explanation regarding our separation. In the online application, the system still asked for PCC, digital photo, passport, medical of my ex spouse. I uploaded a letter of explanation the reasons that I wont be able to provide her digital photo, medical and PCC since we are separated and I wish to exclude her from the application. I also stated in the explanation letter that I listed myself as “married” because legally we still are married and divorced is not recognized from where I come from.

Has anybody been successful in this approach or approached the situation similarly? Thanks!
