So my friend's husband arrived from Cuba a few weeks ago. And it turns out he's a complete and total fraud. She applied on Oct 23rd...and the new conditional PR law only came into effect on Oct 25th. Is she completely out of luck and just has to hope he doesn't go on welfare in the next 3 years...or is it possible she could be protected by the new law?

She will be held responsible for any welfare claims by her "husband".

Your friend should still report it. Sometimes, they actually do something about it but dont hold your breath

Your friend should also hire a private investigator should she become aware that he applied to welfare. Welfare pays very little, and you cannot survive on that amount, therefore, he will most likely be working under the table.

Did she send the application on Oct 23, or did CIC-Mississauga receive the application on Oct 23? The Oct 25 date is when they actually receive your file. So if by chance you applied/sent in the mail on the 23rd but CIC received it on the 25th, then she would be covered under the new law.

Also it looks like the whole PR process only took 4 months and a bit? For an application from Cuba where cases of fraud are pretty high, you'd think CIC would take more time.

It was received on the 23rd so like everyone is saying, it appears she's out of luck.
Cuba is moving insanely fast right now. People are averaging 2-4 months to being approved since the date they submitted and most interviews are being waived. Our process took over a year last year in Cuba. Since Cuba changed their travel restrictions on Jan 14th it seems like Canada is just waving everyone through from there.

I guess thats good news for all of us waiting a long time. If only Ottawa was moving as fast ! 8)

how do you know this? are you basing this assumption on a few people that you know of that have applied recently and gotten visa's fairly quick? (as per CIC website Havana is currently 10 months)
just curious to know if you can back this up

Fraud how? What did your friend's husband do after landing in Canada as a PR?

Yeah, it's about 20 or so people that I know of who were approved quickly/without interview. And them relaying back that on their visa pick-up days there were about 20-30 people picking up visas with no interviews/quick processes too. Totally just based in hearsay, nothing official.
 
ah ok... because I really dont think the new rule that lifted travel restrictions for cubans make a big difference with them getting visa's issued from Canada..
but you never know...it could be less then 10 months

No offense to Cubanos and their partners, but this is surprising and makes me feel very uneasy and unfair.
 
so this is what i see it.... Cuba VO processed applications way faster than what is reflected on the website... wow....
i can't believe this, sham marriages goes thru without even an interview for a very quick time while there are a lot of genuine marriage that are waiting for ages to be process.... GOOD JOB VISA OFFICERS.....THAT'S WHAT WE CALL FAMILY REUNIFICATION...
