Hi. Can anyone help me. We got married in Montreal on 8th of january 2013, we dont have the marriage certificate yet. We wanna submit the spousal sponsorship. Can we submit it with the paper we have and that prooves that we are married??? and after we get the marriage certificate send it later to CIC??? thanks

Typically it is always best to send a complete application package. When things are sent separately there's a greater chance for delays, lost items and so forth.

I've learned to always prepare for the worst.

I would wait for the Marriage Certificate.. Not to delay the processing if I will just to submit it later on.
Complete Requirements mean more smooth and easier to the VO to process your papers. :)

I believe if you just got married like 10 days ago.. it wont last a month for you to get your certs.. :)

thanks very much. Im waiting for my tourist visa now, im afraid that if i wont get the visa and i dont submit the sponsorship application as far as possible i will be in trouble.

What do you mean? Where are you right now? And where are you originally from?

im from Rominia. I was legally in canada for 2 years on a work permit, then i applied to extend my last work permit, but i was refused in june 2012. I contacted a lawer and he told i have the right to restore my status, and i choosed to apply for a visitor status cause i moved to Montreal.

I think you can count on your visitor visa being refused given you're out of status and still in Canada. I wouldn't submit an inland application. I think there's an excellent chance you're going to be asked to leave the country (departure order) once your visitor visa is refused. If you receive a departure order, you'll have to leave or the departure order will turn into a deportation order.

You should have listened to the lawyer and restored your status. Too late now unfortunately.

but i read that even if you have no status in Canada you can submit spousal sponsorship application?

You can. However based on what you've written, you've submitted a visitor visa application while you have no status in Canada. If that's the case, this visa is going to be refused and you're going to be asked to leave Canada once CIC realizes you're still here. You shouldn't have submitted the visitor visa application.

No no, after i was refused of my work permit i had the right to restore my status within 90 days, so in this 90 days i applied for a visitor. Can you help me here scylla?

and what do u think about marriage certificate? can i send only the proof that we are married for now???

You should have submitted an application to restore your status. This is different than submitting an application for a visitor visa. If you submitted an application to restore your status, then this was the right thing to do and hopefully you'll be approved. If you submitted a visitor visa application, then you should expect a refusal.

CIC will not accept any other proof OFFICIALLY except the certificate.

After how long they usually start looking into your file after they receive it???

Right now it's 55 days outland, 6 months inland. So within that time period.

However, that said, when they see there is no marriage certificate, they will either send it back, or send you a letter asking for it. Either way, it delays your application by double the first stage (above)
