My fiancee and her family applied for Canadian immigration a few years back. At the time of submitting the application she was dependent on her father. Their application has been accepted and soon she is going to fly to Canada. I want to confirm if she could marry before flying to Canada. If not so, then please tell me if there is any possible legal way to get married without jeopardizing her immigration?

PS: I am not in Canada and I have never applied for Canadian immigration.

If she gets married or enters into a common-law relationship, then she is no longer eligible as a dependent.

Have you lived together for 12 months? If so, then she is no longer eligible anyway.

She could get married after she lands, provided she is not already common-law. So she could land, return home and get married. Then return to Canada and sponsor you as her spouse.

Mileyaway, Thank you for the helpful response. No, We are not living together or having common law relationship, just engaged. Is there any time restraint to get married after she lands in Canada or she can return back anytime and get married? After getting married she can sponsor me anytime or she would need to wait for 5 years to sponsor me?

She can sponsor you once you are legally married and have gathered all the required documents. There is no wait period.

As a PR, she will need to be in Canada throughout the process, with the exception of short visits.

As I mentioned earlier that her application was initiated as dependent, would that fact impact her immigration in anyway if she lands in Canada, goes back to her home country right after and gets married?

No, it will not have any effect on her. The only way her PR could be affected is if she no longer is dependent on her family and no longer classed as such, like Miles Away mentioned.

As long as you and she have no lived together, in ANY household for 12 months and she is not married to you, she will remain a dependent on her fathers application.

There is no restriction on when she can return to you and get married after she has completed the landing process and become an official PR of Canada.

The above mentioned process is correct because I have been through almost similar situation. First I came to Canada on dependant visa then got married and applied for my husband's spouse visa. Now it is under procedure and hope gets sorted out soon.

Hi,

I have landed to Canada in January on family sponsorship but i came back in February 2016 without getting my PR card. Now, my wedding will be in august 2016 outside canada. My questions are

1) Since i dont have PR card, after getting married outside canada if i apply for travel document, then will my relationship status can affect my travel document visa issuance??

2) If i get married , can they reject my PR status??

Kindly reply

1) No - it won't impact it.
2) No - it won't affect your PR status.
