Hello guys!


I have a doubt regarding marriage application. I've heard that if I do my Permanent Resident application through the use of a representative (Immigration Lawyer), after I get married with a Canadian citizen, I would not be obligate to live with the person who I get married and I could wait for my application without her?

Please, I would like to know as soon as possible!

The rules are the same whether you use a representative / immigration lawyer or you don't. Applying through an immigration lawyer doesn't change any rules.

So you mean that I would need to follow the rules that is live with the person?

Unless you've been married, conjugal or common-law for over 2 years, or have children together. Using a rep or lawyer has absolutely nothing to do with it.

Agreed.

OP - the question you've asked is quite confusing. To be honest, it makes it sound like you're looking to enter into a marriage of convenience to try to obtain PR status in Canada.

Yes. If you don't want to live with your spouse, maybe you shouldn't get married. It sounds like you are planning a Marriage of Convenience...

Ok I got it. Actually I haven't been....... So, there is no way to apply for PR without live with her and follow the rules. Thanks for your answer.

No I'm not planing to do it. Actually would be hard to live with her (right now) after marriage because she lives in Calgary and she cannot move to Kingston at this moment yet, perhaps within a few months. Because that I'm concerned about my application.

I think what you are asking is "if you have to live with your wife during the time your application is being processed? " if this is the question, answer is no, you can live apart while your application for PR is being processed (regardless if you use a lawyer or not).

Oh, yes he/she did word it that way. If that's the case, you can infact live without your wife before she lands. However you are going to want to explain to CIC why you are both in Canada but not yet living together, because that will throw a red flag. You should probably also show proof you intend to live together after the PR.
